Totalitarian science lets you know you’re living in a totalitarian society.

The government, the press, the mega-corporations, the prestigious foundations, the academic institutions, the “humanitarian” organizations say:

“This is the disease. This is its name. This is what causes it. This is the drug that treats it. This is the vaccine that prevents it.

“This is how accurate diagnosis is done. These are the tests. These are the possible results and what they mean.

“Here are the genes. This is what they do. This is how they can be changed and substituted and manipulated. These are the outcomes.

“These are the data and the statistics. They are correct. There can be no argument about them.

“This is life. These are the components of life. All change and improvement result from our management of the components.

“This is the path. It is governed by truth which science reveals. Walk the path. We will inform you when you stray. We will report new improvements.

“This is the end. You can go no farther. You must give up the ghost. We will remember you.”

We are now witnessing the acceleration of Official Science. Of course, that term is an internal contradiction. But the State shrugs and moves forward.

The notion that the State can put its seal on favored science, enforce it, and punish its competitors, is anathema to a free society.

For example: declaring that psychiatrists can appear in court as expert witnesses, when none of the so-called mental disorders listed in the psychiatric literature are diagnosed by laboratory tests.

For example: stating that vaccination is mandatory, in order to protect the vaccinated (who are supposed to be immune) from the unvaccinated. An absurdity on its face.

For example: announcing that the science of climate change is “settled,” when there are, in fact, huge numbers of researchers who disagree. —And then, drafting legislation and issuing executive orders based on the decidedly unsettled science.

For example: officially approving the release and sale of medical drugs (“safe and effective”) which go on to kill, at a conservative estimate, 100,000 Americans every year. And then refusing to investigate or punish the purveyors of these drug approvals (the FDA).

For example: permitting the widespread use of genetically modified food crops, based on no long-term studies of their impact on human health. And then, arbitrarily announcing that the herbicide, Roundup, for which many of these crops are specifically designed, is non-toxic.

For example: declaring and promoting the existence of various epidemics, when the viruses purportedly causing them are not proven to exist and/or not proven to cause human illness (Ebola, SARS, West Nile, Swine Flu, etc.)

A few of you reading this have been with me since 1988, when I published my first book, AIDS INC., Scandal of the Century. Among other conclusions, I pointed out that HIV had never been shown to cause human illness; the front-line drug given to AIDS patients, AZT, was overwhelmingly toxic; and what was being called AIDS was actually a diverse number immune-suppressing conditions.

Others of you have found my work more recently, since I started this site in 2001. I always return to the subject of false science, because it is the most powerful long-term instrument for repression, political control, and destruction of human life.

I thank you for your support and interest.

As I’ve stated on many occasions, medical science is ideal for mounting and launching covert ops aimed at populations—because it appears to be politically neutral, without any allegiance to State interests.

Unfortunately, medical science, on many fronts, has been hijacked and taken over. The profit motive is one objective, but beyond that, there is a more embracing goal:

Totalitarian control.

It aims to replace your freedom, consciousness, and intelligence with its own synthetic versions.

California Senate Bill 277 has passed through the Judiciary Committee, and needs another Committee’s rubber stamp before it arrives on the Senate floor for debate—and what looks like a ride into law.

Governor Brown will sign the Bill. Brown has become a standard fool. He’s worn out. Whatever interesting ideas he may have entertained in his former “moonbeam” incarnation are gone in the wind.

Bill SB277 eliminates the personal belief and religious exemptions from vaccination. It also states that children cannot attend public or private school unless they are vaccinated according to the State’s schedule.

Medical exemptions are still allowed, but these won’t be easy to come by, because physicians who grant them will be scrutinized and harassed.

In Committee, before the vote, the Bill was changed to offer two compromises. Personal belief exemptions will be permitted for all future vaccines, beyond the current 10 mandated shots. And children who are now in school will be allowed to forego vaccination (with some limitations).

Eventually, in years to come, you can expect these two “gifts” to be rescinded.

All in all, personal freedom and choice are gone.

Vaccine manufacturers are popping the champagne corks.

For those California parents who are looking for a way out, there is home-schooling. But you can be sure that, at some point up the road, those children will be falsely blamed for “an outbreak,” and pressure will build to force them to take shots.

This Bill is going to become law, unless there is huge uprising of parents between now and the final legislative vote.

Seen in a larger context, the Bill is one element in a thousand-element program that standardly proclaims: if you want security and protection, you must give up your freedom.

Of course, as I’ve pointed out before, this program always overstates the threat from which one needs protection. In fact, quite often, the same agents of the State who offer that protection manufactured the threat in the first place.

In the case of vaccines, the preposterous notion that vaccinated children (who are purported to be immune) need shielding from unvaccinated children is a contradiction on its face.

So is the idea that children who live in poverty, lack nutritious food, and consequently function on grossly weakened immune systems can gain substitute-protection via vaccines. The reverse is true: vaccinations attack their already-compromised level of health.

In any event, parents seeking their own information about vaccines becomes a useless fantasy under this new California Bill. Everything is decided for them by the State.

In case you want to place all the blame on Big Pharma and its undue influence, keep in mind that government is where the buck is supposed to stop. This is the place where officials can say no if they want to.

Letting them off the hook as helpless victims of corporate power is absurd. They aren’t helpless. They go to the slaughter willingly. Sometimes, with deeper pockets.

Vaccination=protection is the equation that has been shoved down the throats of the population. And to back it up, we have the ever-popular, “This is science. Only crazy people oppose science.”

Ever since 9/11, protection has risen as the most important government theme: “Let us protect you, let us do our jobs, keep your mouths shut and everything will turn out well.”

People buy it. Their minds are vacuums, and they need something to fill it. Might as well be “protection.” Seems important. Seems right.

Seems like the sort of thing a parent is supposed to provide.

“Yes, I remember as a child that Daddy told me (or I wish he had) that everything would be all right. When the government tells me that now, it feels good.”

So does an endless supply of tranquilizers. Until it doesn’t.

Until the brain turns to mush.

I’ll just give you the horrific quotes now and discuss the source afterwards:

“…appropriately prescribed prescription drugs are the fourth leading cause of death…About 330,000 patients die each year from prescription drugs in the US and Europe.

“They [the drugs] cause an epidemic of about 20 times more [6.6 million per year] hospitalizations, as well as falls, road accidents, and about 80 million [per year] medically minor problems such as pains, discomforts, and dysfunctions that hobble productivity or the ability to care for others.

“Deaths from overmedication, errors, and self-medication would increase these figures.”

In other words, the 330,000 deaths per year, the 6.6 million hospitalizations per year, and the 80 million “medically minor” problems per year…all of this stems from CORRECTLY PRESCRIBED medicines.

The quotes come from the ASA [American Sociological Association] publication called Footnotes, in its November 2014 issue. The article is “The Epidemic of Sickness and Death from Prescription Drugs.” The author of the article is Donald W Light.

Donald W Light is a professor of medical and economic sociology. He is a founding fellow of the Center for Bioethics at the University of Pennsylvania. In 2013, he was a fellow at the Edmond J. Safra Center for Ethics at Harvard. He is a Lokey Visiting Professor at Stanford University and a Fellow of the Royal Society of Medicine.

It’s been my policy to quote medical analysts who have mainstream credentials, when it comes to adding up the results of medical-drug destruction.

I do this to show that, in refusing to fix the holocaust, the federal government, medical schools, and pharmaceutical companies can’t claim a) their critics and detractors are “fringe researchers” and b) there really isn’t a problem.

Believe me, the officials who should have been fixing the enormous tragedy for at least the past 15 years are intent on hiding it.

When you stop and think about the meaning of these numbers, one of the things you realize is: this massive destruction of life envelops whole countries.

It not only maims and kills, it brings emotional turmoil and loss to the families, friends, co-workers, and colleagues of those who are killed and maimed: the 330,000 who are killed and the 6.6 million who are hospitalized and the 80 million whose productivity is hobbled or whose ability to care for others is significantly diminished.

If you consciously set out to bring a nation to its knees, to kill it, to disable it, to make it unable to function at any reasonable level, you would be hard pressed to find a more effective long-term method than exposing the population to the US/European medical-drug cartel.

This operation has various stages. It can be applied to issues like vaccination, GMO food, climate change, fake epidemics, elections, war—and it can be applied widely across the general subject of reality itself.

It begins with some “authoritative” voice proclaiming an idea is a fact. Well, someone has to start the ball rolling.

Very quickly, according to plan, others pick up the ball and echo the original idea. This includes both “respected” individuals and groups. Media join in.

What follows is a scramble to gain public acceptance. All sorts of approaches are used in this stage of the process:

the claim that a consensus has already been reached (which is a lie);

attacks on dissidents and critics;

warnings that refusal to accept the central idea will have dire consequences “for all of us”;

cooked and slanted scientific studies;

general reminders that the idea being promoted represents the greatest good for the greatest number;

expressions of shock that there are “still people who refuse to accept the obvious”;

new laws and regulations hammered into existence;

subsequent legalized coercion;

arguments so illogical and bizarre that people accept them, thinking they themselves must be missing the point;

relegation of dissent to the margins of “wild conspiracy theory”;

the conjoining of dissent with negative images and feelings;

the marginalizing of dissent into legal cases that wind through seemingly endless corridors of a maze;

and, of course, endless repetition of the original idea.

After a suitable period has passed, most people can’t even recall a time when the original idea was seriously disputed.

And yet…none of these strategies would succeed, unless people felt a strong need for a centralized authority that defines reality.

To put it another way, people have a quite minimal tolerance for chaos, in which there are many conflicting views on a subject of key importance.

Years ago, I did interesting experiments with small groups re chaos.

In one part of the experiment, I had the people in the group spontaneously sing a note, all at once, any note. Ten people, ten different notes would emerge.

“Chaos.” Dissonance.

I asked them to listen to the overall musical effect and then voice a note they believed would add greater dissonance to the group sound.

Most of the time, if I let this go on long enough, the group would tend to retreat back into “harmony,” and end up all singing the same note.

It didn’t matter which note. Everyone wound up voicing the same pitch.

This was comfortable. This was acceptable. This was “unity.”

So it is with ideas. Most people prefer that “harmony and unity.” They seek it.

Somewhere in their minds, there is a learned program that asks for consensus, a program that prefers consent to difference.

Dissonance (disagreement) registers as a negative reality.

When I had done these group experiments on and off for a few years, I began my research on what came to be the collections, “The Matrix Revealed” and “Exit From The Matrix.”

I stressed the power of individual unfettered imagination, and offered many exercises to expand the scope and range of imagination.

The program in favor of uniform consent fades and disintegrates in the face of imagination.

What we call reality is a hodge-podge of engineered acceptance.

The basic kernel of reality is the programmed desire for unity, which is nothing like the kind of unity that can occur when individuals who live through and by imagination concur and cooperate.

An individual living a life through and by imagination invents new and unprecedented Reality.

Engineered consensus withers.

“There is a great big elephant in the room for regulatory agencies. It’s the combined effect of many different chemicals acting together on the human body. For example, five different pesticides arriving in your food at once. The agencies don’t want to think about that. They don’t want to run those tests. They want to pretend there is no elephant at all.” (Notes for AIDS Inc., Jon Rappoport)

The date was July 1, 2014. The County government of Maui held a hearing.

It was labeled “POLICY AND INTERGOVERNMENTAL AFFAIRS COMMITTEE, Council of the County of Maui, MINUTES, July 1, 2014” (via County of Maui: Council – Policy and Intergovernmental Affairs Committee (2013-2014))

The purpose? Gain knowledge about the upcoming ballot measure that, if passed, would put a temporary block on all Monsanto/Dow secret GMO experiments in Maui County, pending a complete investigation.

Four months later, the ballot measure did pass—and then Monsanto sued, the vote was suspended, and the case has dragged on in federal court.

But on July 1, 2014, key testimony by the EPA [US Environmental Protection Agency] revealed a massive hole in their regulatory oversight and their “science.”

Put simply, it’s this: the EPA evaluates the toxic impact of pesticides by examining each chemical compound separately—but completely ignores the potential harm that results from these compounds acting together.

No outsider knows exactly how many pesticides Monsanto and Dow have been testing in Maui County. No outsider knows their precise composition. No outsider knows how many of these pesticides are labeled “restricted use,” meaning they are highly toxic.

So naturally, any sane scientist would demand to know all these details; and then he would develop and run tests to discover what harm to health the various chemical combinations would create.

But this is not the EPA’s position.

The EPA has a “divide and conquer” strategy: ignore the obvious fact that dozens of chemicals, entering the body, will have effects beyond what each chemical, separately, will cause.

This is purposeful EPA “see no evil.”

Here are key statements EPA representatives put on the record at the 2014 Maui hearing:

COUNCILMEMBER COCHRAN: …So do you folks test combinations of pesticides in determining, you know, your reasonable, unreasonable impacts?

MR. [BILL] JORDAN [EPA]: We do in some areas and in other areas, we don’t. Where pesticides have what’s called a common mechanism of toxicity, we will take into account the fact that exposure to chemical A and chemical B is likely to add up. When chemicals do not have a common mechanism of toxicity, then our regulatory approach is to treat them as not being additive. This is consistent with advice that the National Academy of Sciences gave in a report they released in April of 2013 on assessing risks to, of pesticides to wildlife. So generally speaking, we try to look at situations where there are common mechanisms but we don’t anticipate any synergistic interactions in the absence of that.”

Later on in the hearing, Dr. Lorrin Pang testifies that the EPA is completely misinterpreting the “advice of the National Academy of Sciences.”

Jordan’s chilling remark about the EPA not anticipating any synergistic interactions is, surely, willful ignorance. It’s on the level of saying, “If you ingest 20 or 30 toxic chemicals, there’s no reason to suspect they’ll produce problems together, beyond their individual ability to cause harm. We don’t need to consider that possibility.”

Patently absurd. And insane.

The EPA’s Jordan, later in his testimony, also defends glyphosate, the primary ingredient in Monsanto’s Roundup, which the World Health Organization has just labeled “a probably carcinogen.” Jordan states that, “as far as herbicides go, this is one of the safer products and as authorized for use by EPA, it does not cause any unreasonable risks to people or to the environment.”

Finally, Jordan doubles down on his pronouncement that there is no need to test pesticides for their combined harm to health. Claiming that the National Academy of Sciences is the champion of good sense, Jordan states:

“They advised us that it’s really not practical to obtain test data on mixtures [of different pesticides acting together to cause harm]…[and] if the exposure to the [individual pesticide] components are gonna be kept at a level that does not have any adverse effect on its own, then you should not expect any kind of combined effect to occur.”

This is on the level of asserting that, since a few familiar chemical compounds don’t, individually, cause explosions, then combining them in a barrel and connecting them to a fuse and lighting the fuse should be no problem.

It would take a sixth-grader, with a reasonably good science course under his belt, about 30 seconds to refute Mr. Jordan and the EPA.

But that Agency isn’t worried about criticism. It has other issues on its collective mind. For example, providing cover for Monsanto and Dow and their pesticides.

Last November, the citizens of Maui made their voices heard. They voted to place a temporary stop on all local Monsanto/Dow GMO experimentation, pending a complete investigation into its details. Monsanto and their allies immediately sued, the case went to federal court, and the vote has remained unenforced ever since.

That’s called justice.

And now you see the EPA has absolutely no interest in ever doing inspections in Maui, to see what the combined effects of Monsanto/Dow pesticides are on the population.

More of the same kind of justice.

We’re talking about Tony Abbott, who just ruled from on high that there are no more exemptions from vaccines in Australia.

No more conscientious objections, no more religious exemptions. Only the rare medical exemption, permitted by a doctor. And suddenly, every family who refuses vaccinations for their children will lose up to $15,000 per year, per child, in federal support money. Every family in Australia is eligible for federal money.

Tony has officially ripped away citizens’ right to choose. Australia is now officially a medical police state.

But…

Back in 2006, Tony was singing a very different tune concerning his own daughters.

On November 9, 2006, news.com.au had the story: “Abbott rules out cancer vaccine for his daughters” (see also theaustralian.com.au “I could be seen as ‘cruel’ on Gardasil: Abbott”):

“FEDERAL Health Minister [at the time] Tony Abbott has said that while he may be seen as a ‘cruel, callow, callous, heartless bastard’, he would not be rushing to have his own daughters vaccinated [with the HPV shot] against cervical cancer.

“‘I won’t be rushing out to get my daughters vaccinated, maybe that’s because I’m a cruel, callow, callous, heartless bastard but, look, I won’t be,’ Mr Abbott said on Southern Cross radio.”

How interesting. How revealing. Tony Abbott, a vaccine refuser. Then. But now he’s the Pope of forced vaccinations for all Australians, whether they want them or not.

I don’t see Australian media outlets rushing to cover this contradiction. A reader pointed me to the 2006 article. Otherwise I never would have known about Tony’s double life.

Back in 2006, Tony had a bizarre justification for his anti-vaccine stance. The news.com.au article spells it out:

Tony: “If there is a national immunisation program [that includes the HPV shot], I certainly will be making sure that they [his daughters] get vaccinated under the program.”

Tony: “The [national] program is what the experts think clearly is absolutely necessary, and at the moment the experts don’t think this [HPV shot] is absolutely necessary.”

The article continues:

“The PBAC [Pharmaceutical Benefits Advisory Committee] yesterday knocked back the application from Australian manufacturer CSL to make the Gardasil [HPV] vaccine available free to all females aged 12 to 26.

“Gardasil halts the spread of sexually-transmitted human papilloma virus (HPV), which causes 70 per cent of cervical cancers. At present it costs $460 for the recommended three doses.

“The PBAC said it made the decision because the vaccine program – which would have cost about $625 million during its first four years – was not value for money.”

Let me take this apart.

Tony was saying he wouldn’t have his daughters vaccinated with the HPV shot because there was no national program for it.

That’s like saying, “If the supermarket doesn’t sell cherries, I won’t let my daughters eat them.”

You see, the only reason a national program to vaccinate girls with the HPV shot wasn’t instituted, in 2006, was because of money. The cost vs. value of the program was determined to be “not worth it.”

Conventional researchers, doctors, and vaccine manufacturers in Australia were quite confident, in 2006, that the vaccine was safe and effective. Otherwise, they never would have considered it, in the first place, for the national vaccine program.

(As far I’m concerned, HPV is one of the most useless and dangerous vaccines in existence, but for the purposes of this argument, we’re talking about the conventional mainstream view.)

Tony was deciding to reject what he considered to be a safe and effective vaccine for his own daughters—for whatever bizarre reasons he cared to advance. Because he had the right to choose. And because he held a high post in government. And because he decided he could do whatever he wanted to do.

But now, flashing forward nine years, Tony is telling every person in Australia what they have to do. No choice. No freedom. No right to seek out information independently and make a decision based on that information.

Australia is a medical police state, with Tony, the old vaccine refuser, at the helm.

If that isn’t cause for uproar in the Land Down Under, what is?

“Hi, I’m Tony. I’m your boss, your ruler, your King. What I say goes. For you. But not necessarily for me. That’s the way it works, don’t you know? The King makes rules for everyone else, but he can do what he damn well pleases. He’s above the rules. He’s different. He’s the Lord of the idiots and slaves, but he himself is free. That’s the deal. It’s none of your business. Just keep your eyes straight ahead and your mouths shut and march forward. That’s your fate. I so command it.”

Last year, the voters of Maui County passed a moratorium, a temporary block on all local Monsanto/Dow GMO experimentation, pending an independent investigation to assess the harm of this secret experimentation.

Immediately, Monsanto and Dow sued. The effect of that lawsuit was to suspend the entirely legitimate vote and put it in limbo, where it has remained, as the case drags forward in federal court.

Astonishingly, the County of Maui government joined the lawsuit on the side of Monsanto and Dow.

This government, whose citizens had just created a new law with their vote, lined up against those very citizens.

“Defend the vote of our own people? Of course not. We’re going to nullify that vote and say it was illegal, even though it wasn’t. Who cares about voting?”

One might suspect the County of Maui government has acted in a corrupt fashion on other occasions and…

Lo and behold…the County has been injecting enormous amounts of foul waste water into wells for the past eight years, every day.

Wait. Not merely for eight years. Since 1994.

Hold on. According to EarthJustice lawyer, David Henkin, who has been involved in a federal case against the County of Maui, the County has been doing this since the 1980s.

Here’s a quote from MauiNow.com, dated June 2, 2014 (“Federal Ruling: Maui County Is Violating Clean Water Act”):

“The county’s use of injection wells at the Lahaina Wastewater Reclamation Facility in West Maui violates the federal Clean Water Act according to a federal district court ruling on Friday, the environmental law firm Earthjustice announced.

“Earthjustice reports that the court concluded that most of the three to five million gallons of wastewater that is injected into the wells each day flows through groundwater and emerges offshore of the popular Kahekili Beach Park.

“According to Earthjustice, the court noted that ‘the coral reefs near the submarine seeps have been subject to algal blooms that have led to a decline in coral cover from 55% to 33% between 1994 and 2006’.

“Earthjustice attorney David Henkin said that under the Clean Water Act, ‘Maximum penalties in this case already exceed $100 million,’ and he said, ‘the meter is ticking at a rate of over $100,000 per day’.”

The County Government of Maui has been injecting 3 to 5 million gallons of waste water, per day, into those wells.

The MauiNow article includes a quote from Angela Howe of the Surfrider Foundation:

“Destroying coral isn’t the only problem the injection wells cause. The county’s wastewater contains chemicals like pharmaceuticals and fire retardants that also travel from the injection wells into nearshore waters, threatening local residents and tourists swimming and surfing at Kahekili Beach.”

It gets worse. Even though Maui County government was found guilty last year, no penalty has been imposed yet.

The penalty phase of the case won’t commence until August 11 of this year.

And according to Earthjustice lawyer, David Henkin, Maui County continues to pump waste water into those wells, even now.

Even now.

Maui County government at work. Poisoning the water; and suing its own citizens for voting to investigate Monsanto and Dow.

A perfect wave. Of corruption.

Freedom is. It’s the natural state of being.

Before limitation and slavery, there was freedom.

It had no party, no law, no mandate. It just was.

Freedom was and is the simplicity in the tangle, the force that has no equal.

Without it, everything withers, everything is turned into a program.

During my 30 years as a reporter covering “the news behind the news,” I’ve seen countless instances in which the Matrix shows up, swims into view.

The Matrix, the central image, is a lie. But not just any lie.

It is very deep, shared, hypnotic picture of reality.

People need more power—more individual power, so they can both stand and operate outside the Matrix.

The entire mural of imposed Reality is aimed at radically diminishing the individual’s power.

So in addition to my work as an investigative reporter, I’ve been researching the individual’s ability to go beyond this mural of reality.

Power Outside The Matrix, my third collection, is all about being able to think, act, and create both outside and inside The Matrix. Because that’s the goal: to be able to function in both places.

People are consciously or unconsciously fixated on boundaries and systems. They are hoping for whatever can be delivered through a system.

That fixation is a form of mind control.

Freedom isn’t a system.

But freedom needs creative power.

At one time or another, every human being who has ever lived on this planet has abandoned his creative power. The question is: does he want to get it back?

It never really goes away. It is always there. It is the basis of a life that can be lived. A life that can be chosen. People instead choose roles that don’t require that power. They think this is a winning strategy.

It isn’t.

A section of my mega-collection, titled Power Outside The Matrix and The Invention of New Reality, features creative exercises you do on a daily basis that will help a committed individual move toward the goal of power outside The Matrix. The exercises are all about increasing your energy and stability—and about the invention of new spaces.

Monsanto/Dow still refuse to open up secret court documents

Think about it. You’re locked in a high-stakes lawsuit against major corporations, and you can’t see document-material the corporations have filed in order to make their argument with the Judge.

The Judge has seen the redacted blacked-out material, and she will, in part, base her ruling in the case on it. There is no jury.

But you can’t see the blacked-out material, you can’t argue your position with full knowledge.

Welcome to a rigged process.

As my readers know, I exposed the fact that, in the Monsanto/Dow vs. Maui lawsuit, the corporations filed documents with the court that contained large amounts of blacked-out redacted material.

The lawyers representing the people, whose vote to block Monsanto/Dow experiments in Maui was suspended by this lawsuit, have not yet seen those redacted lines and paragraphs.

Therefore, they can’t argue their case from full knowledge.

In the last few days, one of the lawyers, Sharon Kim, who represents the Shaka Movement against Monsanto/Dow, made a request to Nick Kacprowski, a lead attorney for Monsanto/Dow, to see the redacted material (Case 1:14-cv-00511-SOM-BMK Document 5-3 Filed 11/13/14: Declaration of Sam Eathington [Vice President of Global Plant Breeding, Monsanto]).

Their exchange of emails concludes with Kacprowski writing:

“We should note that nothing in this message should be construed as conceding that Shaka has any right to access the sealed information. For example, Plaintiffs [Monsanto, Dow, and others] are concerned by the hostility that Shaka has shown toward the [GMO] seed companies in the past and thus by the risk that it will use this confidential and sensitive information publicly for improper purposes.”

Absurd. How Shaka “would use this material” is a speculative hypothetical. The material’s relevance to the lawsuit can only be assessed by allowing Shaka’s lawyers to read it.

The Judge in the federal case, Susan Oki Mollway, should long ago have ordered that the redactions be removed.

Here is the email exchange. The first email is from attorney Sharon Kim, representing the Shaka Movement. The reply is from Nick Kacprowski, representing Monsanto/Dow. His reply is dense with legalese, but you’ll get the point of it.

This email is serves as a request for unredacted copies of the documents that were filed under seal in Civ No. 14-00511. As you are aware, our Opening Brief for the Ninth Circuit Appeal is due on April 30, 2015, and we need the unredacted documents to aid in the preparation of our Opening Brief. Thus, we are requesting copies of the unredacted documents by Wednesday, April 22nd. Please let me know if you have any questions.

This will respond to your request that Plaintiffs provide Shaka with unredacted versions of the sealed documents in this case by April 22. As you know, Plaintiffs have filed a Motion to Vacate the Expedited Briefing Schedule on your appeal, Case No. 15-15641. As our motion notes, your appeal of the preliminary injunction order will be mooted when the Court rules on the merits of the pending summary judgment motion, which it has indicated it will do by the end of June. If the Ninth Circuit grants the Motion to Vacate, Shaka will have no need for the unredacted documents in the near future, and possibly never, in order to pursue an appeal in this case.

Our proposal is that the parties stipulate to a protective order that provides that the sealed documents will remain sealed, without access for Shaka, unless the Ninth Circuit denies Plaintiffs’ motion that the briefing schedule should be vacated in Case No. 15-15641. It makes sense to defer Shaka’s request to access the sealed documents given that: 1) the sealed documents contain highly sensitive and proprietary information; 2) there is no protective order in place and there will be tricky issues to work out regarding what, if any, information in the documents Shaka should be allowed to access and what the restrictions governing the use of the documents will be; and 3) the Ninth Circuit’s ruling on the Motion to Vacate may soon moot the issue of needing those documents for the appellate record.

We realize that Shaka’s appellate brief is due on April 30, 2015, and that the Ninth Circuit may not rule on the Motion to Vacate before then. Therefore we are amenable to stipulating to extend the time to file Shaka’s appellate brief until 30 days after the Ninth Circuit rules on the Motion to Vacate. If the Ninth Circuit denies the Motion to Vacate, we can then meet and confer further about your request.

We should note that nothing in this message should be construed as conceding that Shaka has any right to access the sealed information. For example, Plaintiffs are concerned by the hostility that Shaka has shown toward the seed companies in the past and thus by the risk that it will use this confidential and sensitive information publicly for improper purposes.

Please let me know if you agree with this proposal, and we can prepare the draft protective order. If not, please let me know if there is a time tomorrow when we can meet and confer in person or by telephone about this issue.
