Dispatches from the War: vote fraud, lawyers, COVID vaccine, Biden plan, police powers, the Constitution

Here is an immortal statement every independent thinking person should frame, hang on the wall, and re-read often—

Gerry Spence, American lawyer: “Everyone wants to argue. Everyone does. Everyone needs to.” “While birds can fly, only humans can argue. Argument is the affirmation of our being. It is the principal instrument of human intercourse. Without argument the species would perish. As a subtle suggestion, it is the means by which we aid another. As a warning, it steers us from danger. As exposition, it teaches. As an expression of creativity, it is the gift of ourselves. As a protest, it struggles for justice. As a reasoned dialogue, it resolves disputes. As an assertion of self, it engenders respect. As an entreaty of love, it expresses our devotion. As a plea, it generates mercy. VOTE FRAUD:

Contesting the election on the issue of vote fraud is not a violation of “playing fair” and “accepting results” and “remaining calm.” It is an argument being made. It is also a question of fact.

What is unhinged is demanding a smooth transition from one president to another, since it is the news networks who made the projection of a Biden victory, and it is those same networks who are featuring the need for that smooth transition “in a democracy.”

“We project Biden as the winner. Therefore it is a mathematical certainty. Therefore, do not resist. We are in charge.”

THAT’S the banana republic.

That’s the military busting in the door and taking over the radio station…except there is no need for the military, because the networks are the radio station.

Here are a few comments, based on my observation of a vote-count in the LA County Registrar building, when I ran for a seat in the US Congress in 1994.

EVERYTHING BECOMES ELECTRONIC.

Paper ballots, mail-in ballots, punch cards, touch-screen—it all goes into the hopper. It’s all translated into computer sub-totals and totals.

There are various stops along the way, where the numbers are transferred into other machines and systems.

Fraud can occur anywhere during this route.

As an observer standing there, in various rooms, staring at machines, you see nothing on that level of fraud. How could you?

Only real pros can tackle the job of discovering electronic/computer fraud, and I’m not even approaching the fraud that can occur earlier, inside touch-screens in voting booths.

I’m not trying to downgrade any of the discoveries people have made so far that point to vote fraud—which include software/electronic fiddling. Startling crimes have already come to light. And yes, as a close-up observer in a counting room, you can spot obvious felonies. But never ignore what you can’t see.

I don’t know how competent and skillful Trump’s lawyers are. I don’t know how determined they are. They need to be relentless. They need to be counting how many votes they’re trying to overturn. A few minor victories aren’t going to matter.

LAWYERS GROUP and COVID VACCINE:

Here is another group of lawyers; the New York Bar Association. On November 7, as the New York Law Journal reports: “The New York State Bar Association on Saturday passed a resolution urging the state to consider making it mandatory for all New Yorkers to undergo COVID-19 vaccination when a vaccine becomes available, even if people object to it for ‘religious, philosophical or personal reasons’.”

In case you think this resolution has anything to do with the law, think again. Yes, the Bar Association is criminally convinced the State has the Constitutional power to force a vaccine on the population, but their resolution is recommending the State should actually do it. That’s not law, that’s health policy, that’s medical policy, that’s “science.” That’s also Police State. What is a lawyers’ association doing recommending medical decisions?

It’s lining up with Joe Biden and his forthcoming “national plan to conquer the pandemic.” It’s signaling, “We’re on board with you, Joe. Don’t worry about us. We’re for sale, we’re for hire.” It’s old-fashioned partisan politics and deal-making masquerading as some sort of legal brief. It’s a message to card-carrying lawyers everywhere: Mandatory vaccination should be your bias in all cases.

The New York Bar Association is quite a bunch of bottom-feeders.

BIDEN PLAN:

Biden has already led with his first priority: appointing new people to the coronavirus task force. As I’ve warned, he and his handlers want to issue edicts from the federal level on testing, tracing, masks, distancing, lockdowns, and vaccination, in an effort to override any defections from state governments.

The devastating economic destruction which has already been forced on America is not enough. There must be more. Not only through enacting new COVID restrictions, but also through moving climate change back up to the top of the federal agenda. This means reducing overall energy-output from US industry.

That also translates into greater federal control of the economy. It’s even possible we could see price freezes on goods.

Dreamers will, of course, applaud all these actions, because dreamers believe jobs and money and security will come flowing magically from the White House. Joe is the great healer. Trump argued and insulted. Tsk, tsk. Joe placates. It’s nicer. It’s a sign of love.

Joe’s social justice agenda is an odds-on favorite to include defunding police departments and restructuring them as “community share-and-care projects.”

“We saw you rob that liquor store and shoot the manager. What do you think produced that level of anger in you? Let’s sit down and talk about it.”

COVID, as planned, accelerated tyrannical trends. COVID’s new preacher is Joe Biden.

Current revelations about his dealings with China and Ukraine aside, Biden is an old con artist from Delaware. In 1987, shortly after launching his campaign for the presidency, a few of his lies surfaced. He plagiarized a speech by a British politician. He plagiarized lines from a Robert Kennedy speech. He lied about his past academic record and law school student ranking.

Moreover, the mainstream press roasted him mercilessly for these lies. Some of the same big-time news people who excoriated him then as a fraud and a hustler, and drove him to withdraw from the presidential race, in 1987, took up a whole new position in 2020: Puff-o-fantastico; Joe was good, Joe was clean, Joe had no problems.

Perception may be reality, but when media perception is miraculously elastic, and can expand or contract at the drop of a hat or the drop of cash money, all bets are off.

POLICE POWERS, THE CONSTITUTION:

On the subject of lawyers, vaccines, police powers, the Constitution, and the elasticity of perception, get a load of this:

Guess what? There is now a BELIEF clause written into the Constitution. “If the right people THINK something is so, it IS so.”

Note: The full-on legal lunacy I’m going to cite is…

Defended by many lawyers and public health officials. They say the State’s police powers, during a pandemic…

Can’t be challenged.

Fortunately, lawyers like Tom Renz and Bob Kennedy disagree.

Buckle up.

In April of 2006, the AMA (American Medical Association) Journal of Ethics published an article, “Is Mandatory Vaccination Legal in Time of Epidemic?” by Sarah Fujiwara, MD.

Referencing prior US Supreme Court decisions, the article states: “The courts do not become involved in legislation formed under the state’s police power…”

If that sounds like the preface to a bad storm rising; if it sounds like courts abdicating their most basic duty to keep tyrants in check; it gets much, much worse:

“Furthermore, it is immaterial whether or not the vaccine is actually effective, so long as it is the belief of state authorities that the mandatory vaccine will promote common welfare and is a reasonable and proper exercise of the police power.”

WHAT?

It’s immaterial…?

It doesn’t matter whether the vaccine is effective?

It only matters whether politicians BELIEVE…?

Believe what?

That the vaccine will promote “general welfare?”

And also the politicians BELIEVE the mandatory vaccine is a proper exercise of their POLICE POWERS? That’s all that matters?

This is on the order of saying, “If public health officials believe the use of poisonous snake oil to treat the population is effective, mandated snake oil can be enforced by the police. The US Constitution was embedded with this meaning.”

Sure it was. Obviously, the Founders were struggling to create a new Republic based on random declarations of emergency, mass police raids by men holding needles and vials containing anything from aluminum to mercury, who would hold people down and inject them.

This is what the Revolutionary War was fought for. Anyone should be able to see that.

The basic meaning and spirit of the Constitution WAS ALL ABOUT forced medical treatment, wasn’t it? I seem to remember Ben Franklin and James Madison announcing that very thing as they strolled along the streets of Philadelphia and educated early Americans about the Law of the Land. Ben said, “Needles and vials, that’s what we’ve been fighting and dying for…”

And much later, a poem was engraved in a plaque on the Statue of Liberty: GIVE US YOUR HUDDLED MASSES, YEARNING TO BE VACCINATED.

“As long as it is the BELIEF of state authorities…” This opens the door to: “Well, the committee BELIEVES an army of underground porcupines holding shotguns has emerged from caves and is marching on New York. Therefore, the State must set fire to sixty million acres of land between Albany and NYC. Citizens should evacuate as soon as possible…”

“…it is immaterial whether or not the vaccine is actually effective, so long as it is the belief of state authorities…”

But listen, don’t worry, be happy, let’s cancel the Second Amendment, because we have nothing to fear from politicians and government. Back in the 18th century, the whole business about an armed citizenry was pushed, don’t you know, because of the dire threat of giant roaming Mastodons.

Or was it roaming lawyers and judges, who picked and nicked and scraped and sliced at the Constitution, developing all sorts of key cases that diverted freedom into dead-end alleys and gullies and landfills and empty lots surrounded by barbed wire?

—Let’s revert to sanity. When a State of Emergency is declared, public officials must justify it on the facts, and those facts are up for challenge.

“It’s Science” is not an acceptable generality for explaining why a population is put into house arrest or stuck with a mandatory needle and injected with a brew.

Millions upon millions of us have delved into the details of vaccination. We’ve come out with our conclusion.

NO.

And in our legal research on the Constitution, and the extent to which it favors wide-ranging police powers, based on BELIEF, we offer this highly technical ruling to government officials and their attorneys:

STOP BULLSHITTING.

And to the AMA Journal of Ethics, where such an illuminating confession was published, we say, “Thanks, boys and girls, for letting us know where you really stand. Now there can be no doubt. You’re out of your minds and your conception of ethics is straight out of the Soviet Union and China. You’re the Medical Police State. Message received.”

And listen, old Joe. You and Hunter can take the COVID vaccine first, and all the boosters. The real vaccine, not a saltwater placebo shot for the cameras. You know, the DNA vaccine that alters your genetic makeup permanently, or the RNA vaccine that starts a cascade of auto-immune reactions, as the body basically attacks itself. THOSE vaccines.

      But we won’t be one for long if we let Harris-Biden steal the show that EVERYONE knows Trump won. Trump supporters at his rallies numbered into the thousands, Biden got 6 or 7 people and half of those were reporters.

      Is America really going to allow this?? And, personally, it doesn’t matter to me if it was Trump vs Biden or Humpty Dumpty vs Chicken Little. It still should never go unchallenged when there’s been obvious shenanigans.

          My guess, & that’s all it is, is that the “spirit” of “Philo. King’s” would be only for “good” counsel based on learning. And not “ruling” for power’s sake.

Then take their house and belongings for the criminal trespass they’ve committed. Hit ‘em hard and don’t relent. “I was following orders” is no remedy for their illegal trespass.     Again and again, you Jon and countless other internet fighters for truth make the same mistake since it all started in Feb 2020:

    Writing or making youtube videos will not make any difference. The only opposition now is physical resistance on the streets. But for usa this means at least 30 million patriots coming together with sheer determination and fully knowing they risk life.

    The rest of the world, europe , uk and esp australia have no balls. Only you in USA can do something about it.
    But please, get out from the computer screens!

      You are absolutely correct, Peter. And gun sales have soared into the millions for the past few months, so there’s hope. That fact alone is probably the reason that although the AP has named Biden the winner, most people are paying it no nevermind and Antifa has been cautious, not to mention the general press and denizens of DC have been hiding, afraid they might be staring into the working end of something. However Trump is still Potus and he has yet to step up to the plate in a meaningful way, like enforce the Constitution which is his right as Commander-in-Chief. We are leaderless. He could stop the Lockdown in a heartbeat and thus free people and put a little fear into the hearts of the opposition. Maybe a lot of fear. It’s a very big country and not everyone lives in an urban area. I believe stopping the lockdown and ENFORCING IT, meaning any govs who balk go to jail, might go a long way in avoiding armed confrontation – for awhile.

      He’s doing what he has to. Without people like him, no one would even think about taking to the streets.

      I’ll remind you that it was Sam Adams and Ben Franklin, two printers who were the underground media of the Colonies, that handed out flyers and pamphlets about the British Crown’s crimes and to garner support for the revolt.

      Without people like that, like John, educating and informing the people, no one would even think about revolting in the streets.

      The mistake you make is forgetting that key, crucial aspect. That’s why we have a first amendment, and why it is first, and why the second was put in there by Franklin to protect it.

      The UK and Europe have been resisting. Just search for anti-mask and anti-lockdown protests across England, Italy, Spain, Germany.

      The united States sits down and waits for an election to save itself from itself. The rest of the world has experienced tyranny in recent times. The rest of the world remembers when it was invaded, when the Popes ruled them, when tyrant monarchs exploited them. The united States doesn’t ….. except:

      “Is life so dear or peace so sweet as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take, but as for me, give me liberty or give me death!” (Patrick Henry).

      The first indoor farmers’ market of our season ended and 90% of the mask wearing sellers took them off as they were packing up for the day while their compatriots around them walked up to them, maskless, carried on conversations, laughter, handshaking (without gloves), and general merriment. This from a house of mainly liberals.

      If we just read blogs and their comments and make our own comments, search the internet diligently for contrary information and disseminate it over the internet, the opposition wins. Get off your backsides, people, and get to work. Do not be distracted by the election and the court filings — it has kept you asleep for too long.

      What are you waiting for? crumbs that fall from the tables of your enemies, hoping it will feed you?

      But there is hope:

      1. One of my sisters and her husband have “seen the light” of this whole mess.

      2. Three of my relations in the UK have changed their minds (they are all in their 80s) about this fiasco and are getting angry — they refuse to not gather, despite living in households far apart.

      3. My father-in-law in the UK and his lady of 25 years (who is quite ill with a nerve-endings problem) have refused to believe the dogma since near the beginning.

      4. A very liberal (absolutely hates Trump, loves Bernie and wants Biden to win) friend and fellow vendor at our market who was triumphant over the recent election’s current results believes now that the lockdowns are bad and “covid” is not as bad as being pushed (that took a long while with lots of facts to convince her as well as logic).

      5. I am amassing information to create a file and fly sheets any customer can take. Several vendors are interested, too.

      Perhaps the resistance will begin somewhere small — like Vermont — where we have been open to very “whacky” ideas and like to go against the norm (and the grain), very often to our own doom. But, if perhaps, gentle, liberal, progressive Vermont can be at the forefront of exposing this scam, the rest of the nation will listen.

      So much of this is thanks to Jon and all you commenters. Your hard work will not go fruitless. Perhaps we shall all hang, but let us all hang together rather than separately. Face to face, regardless of the edicts being brought upon you, will be more effective than sitting at the computer. Organize protests of “covid” measures, not the election.

      Trump wins. Trump loses. It does NOT matter. If you do nothing, YOU WILL LOSE EVERYTHING.

      The passages you implicitly reference from Jacobson v Mass. about the belief of public officials being sufficient to mandate a vaccine is only half the story. According to Jacobson, the belief of public officials must be based on the common belief and knowledge of the People. Without that, any mandate is not constitutional.

      Also note, the Jacobson mandate dealt wth a smallpox vaccine which had been around for 100 years- plenty of time for the People to form a reasonable belief. With Covid, there has been no long term safety studies and no vaccine for humans has ever been licensed based on these novel platforms. Any public official or Officer of the Court who claims a legal right to mandate an experimental vaccine is engaged in lawfare. http://www.vaccinelawfare.com

        The smallpox vaccine was made from cow puss and caused more injuries and deaths than smallpox. See “Dissolving Illusions” by Humphries and Bystrianyk.

        Much has changed in science and law since 1905 when the Supreme Court upheld Massachusetts’s mandate against an epidemic “that imperiled an entire population.” The fatality rate from smallpox was 20% to 30%; COVID-19’s is closer to 0.2%. Many politicians and lawyers misread the ruling imagining a blank check for states to impose mandates under police powers. The 1905 Jacobson vs. Massachusetts ruling was used by the eugenics movement to promote forced sterilization. See the book “Imbeciles: The Supreme Court, American Eugenices, and the Sterilization of Carrie Buck”, by Adam Cohen, who presents evidence that the 1905 Supreme Court was populated by eugenicists. The same court in a 1927 ruling in Buck v. Bell upheld forced sterilization, in which Justice Oliver Wendell Holmes simply wrote that the “principle that sustains compulsory vaccination is broad enough to cover cutting the Fallopian tubes.” This 1927 Supreme Court ruling was used by the Nazi doctors to defend their forced medical atrocities they committed at children’s hospitals and concentration camps during their trial at Nuremberg after WWII in 1946 -1949, which led to the development of proper informed consent in the Nuremberg Code which states in part:

        The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision.

        The informed consent concept has also been included in the UNESCO’s Universal Declaration of Bioethics and Human Rights issued in 2007 which states in part:

        Article 6 – Consent
        Any preventive, diagnostic and therapeutic medical intervention is only to be carried out with the prior, free and informed consent of the person concerned, based on adequate information. The consent should, where appropriate, be express and may be withdrawn by the person concerned at any time and for any reason without disadvantage or prejudice.

        Now in fact states must meet criteria of necessity, proportionality, harm avoidance and non-discrimination. Precedents require courts to prevent arbitrary and oppressive mandates like the ones proposed by promoters of the non existing COVID19 vaccine, including the use of exemptions and fines to be paid by those refusing the vaccine, as long as the fines are neither excessive nor violations of the 8th amendment.

          Excellent post B59Y! Would really appreciate your feedback on my site under development, given your substantive response to my post above re Jacobson. Also note, the criteria includes “real and substantial relationship” which is the most critical of all, since a novel biologic can’t meet this test. This sub-part requires common knowledge a “vaccine” is safe and effective and per Justice Harlan this knowledge and belief was fundamental to the Court’s holding.

          In Jacobson, the Court was able to check this box because the smallpox vaccine had been around for 100 years, so the Court took judicial notice the People found it safe and effective. Tell me how this box gets checked with an experimental genetic vaccine that’s never been approved nor subjected to any long term testing? Marbury v Madison prescribes limits which are applicable here, and if the current Court adheres to the Constitution, no vaccine mandate should be permitted.

    I just want to make this perfectly clear. I don’t care what any body of authoritarian control freaks decree; I’m not taking any vaccine. I’ve been done with those since I got out of the army in 1992. I really don’t care which one of the lunatics wins the title of the Big Kahuna either. It’s been a long time since I’ve accepted any man as my master. I rule myself far better than any of the people who claim they own me rule their own selves. And while I practice the principal of non-aggression, I also marry it with the right to defend myself. Count me out of any civil wars or revolutions; but that doesn’t mean I won’t make a stand.

    No one has any right to initiate violence upon another; and that is exactly what a mandatory anything is. Violence.

    I’ll end with a quote from Gore Vidal that I read in the early 80s. It’s powerful enough to have stuck with me all these years. And when you live by them, you will become fearlessly free.

    “To be free, one must be willing to fight anyone,any where, any time, and for any reason”.

    It may not be exact, but I haven’t read it since the early 80s. Most people today are horrified by such a sentiment. Instead, they keep begging others to carry their weight. Such people aren’t worth the effort. And that is why we are in the situation we are in now.

      New Zealand and Australia prove they anticipate your and my feelings. They are declaring the vaccines are not mandatory. They just will not allow the unvaccinated to be in public, nor receive welfare, nor receive the tax breaks regular vaccinated citizens receive.

      At the same time UK govt is searching contractors for someone with an AI robust enough to handle a surge of adverse reactions to the new vaccines that they are anticipating.

I hope they don’t seriously think the mail is any less pilfered these days than our phone calls. EVERYTHING is open to anyone who wants to snoop, NOTHING is private anymore. My husband has had to cancel a very important surgery because he NEEDS that number in order to complete the surgery or else it’s totally unaffordable.

    If Biden becomes the president, I think they are going to eliminate both the Social Security and Medicare programs. So then WHY IN THE WORLD are there constant, constant, constant, all-day-long ads on tv for medicare?? Personally, I they are holding off giving him the information he needs about this medicare number because he’s just at the deadline where they can refuse to give it to him until they change the structure of the medical “payments” system.

    That’s just a guess but it’s also a gut feeling and my gut feelings are rarely wrong.
