Federal judge erases Maui voters, bows to Monsanto

Federal Judge Susan Oki Mollway just told Maui voters: you’re canceled.

Last November, Maui County passed a ballot measure that would put a stop to all local Monsanto/Dow GMO experiments, until an independent investigation could assess the harm to health.

Promptly, Monsanto and Dow sued, the result of the vote was put on hold and never enforced…and now, all these months later, the ruling has come down.

Judge Mollway decided that state and federal laws governing agriculture trump county laws.

In other words, the people have no voice.

The whole issue will now be heard on appeal, by the 9th Circuit Court.

For months, I’ve been saying this issue was never about agriculture or laws about agriculture. This is about human experimentation. Monsanto and Dow have key experimental facilities in Maui County. They’re fiddling and diddling with non-commercial GMOs and toxic pesticides in what amounts to an open-air laboratory.

The federal judge has been barking up the wrong tree. On purpose, of course, because it made it easy for her to side with Monsanto/Dow and against the Maui voters.

Let me boil it down. Again. There is whole list of GMO food crops (corruptly) approved by the federal government. Farmers can grow them and sell them. Stores can sell them to people who eat them.

But if a company (like Monsanto) is experimenting with GMO plants and pesticides which haven’t been approved, that has nothing to do with “laws about agriculture.” It has to do with “research.”

And the people who live next to the “research” and, for example, are sprayed by the pesticides, have every right to demand an investigation. Into safety.

And meanwhile, it would be a crime to allow the experiments to continue.

Analogy: Some corporation with a lab that does research on viruses decides to conduct “transmission” studies and “contagion-factor studies” in Beverly Hills, on traffic-clogged Santa Monica Boulevard.

People object.

A judge rules that state laws on granting drivers’ licenses trump the objections.

Yes, it’s that crazy, that absurd.

But of course, logic plays no role here. Money does. Money and power and political clout and corporate-government partnerships. And Big-Ag control of the food supply. And a sold-out judiciary.

This Maui case has to be rethought, refiled, and publicized widely on the basis of dangerous human experimentation.

    THIS WAS ONE OF THE GREATEST SOCIAL AND ENVIRONMENTAL ISSUES AND CASE IN THIS CENTURY; and, as many times as I tried to bring this to light amongst all the exceptionally commenters on this blog–no one participated… ..so, I’ve given up on Jon Rappaport, for whom I have a great deal of respect and those who are followers of this useless blog…

      Dr. Kimo Kala: Do your citizens have bulldozers that can pull 10+ bottom plows….If so, put them to good use. The legaleze B.S. played by the court system(s) is definitely not working in your favor.

        All over the country side around my little town, and they dump it in the school yard and the playground and along the edges of the sidewalk.
        Then the old retired farmers who live in town and grow gardens, dumb it on their gardens and around their edges of their property and along fences. I have seen them spray along the edge of the primary school building. People got around squirting it on individual dandelion…strange dandelions were brought to Canada in the 1600’s as a food source. It is highly nutrious.

        Round-up drains into the wetlands.
        I have seen a flock of 100 sparrows fall from the sky because of the helicopter spraying of round-up on a field of wheat in the fall to desiccated the wheat crop.
        Everybody in this town dies of cancer…but they seem to make the connection that 1 plus 1 equals cancer.
        I knew a farmer who put round-up in a paint tray and used a paint roller to apply it around his evergreen trees…he’s dead now.

        Sorry I am too busy over here Kimo Kala to help you in Maui. We are swimming in round-up.

          Sorry to hear this, Michael. I thought you were safe in North Central Saskatchewan. Here in Laval, Québec, we don’t have so many farm fields. We use to have a lot of them when I was young, but now they are almost all gone.

          But we get a lot of chemtrails. Every day, I can see them running right over the place I live in. I hope there won’t be so many where I’m moving to in 15 days.

          It makes me so mad to see these idiots destroying our planet and our health. It’s hard for me to believe that seven billion people cannot seem to be able to win over this tiny group of criminal psychopaths. Where has all our power gone to?

          I hope that the message of Jon, about imagination, creativity and individual power will reach the mass in time to save this beautiful planet we live on.

    This is the one of the main problems with these trade agreements. Local imput is over ruled by corporate might. Who’s going to pick up the tab when birth defects or other ill effects occur because of their experimentation?

    It seems judges can’t be relied upon to be honest when it’s counter to corporations’ interests. This places the burden on people to learn about and boycott harmful products.

    We visited Kauai in August of 2014 . We snorkel and scuba dive, what we saw was heart breaking. The reef is dying, the turtles have tumors, Monsanto & friends are experimenting and it’s all flowing out to sea from the Waimea river. I really feel for Kauai as I have been visiting since 1973. The courts are now part of the corporatocracy and their will is all that matters.

    With all the Celeb’s and Hollywood Elite that come to Maui every year, and live here and claim to Love Maui where are they? Why aren’t they speaking out and getting the word out what is happening here? Why aren’t they giving back and helping to save Maui from Monsanto? We need their help. We need donations, Their voices could be heard and they could help make a difference. I guess when Maui becomes a toxic dump they’ll just move on to another island ,if there are any left. Rob Schneider ,Neil Young and Lukas & Micah Nelson and Promise of The Real have all supported and spoken up on our behalf. It helps give us the strength we need to continue fighting this battle, that we are

Maui is prime for it’s land & perfect weather for the spraying of their chemical cocktails and perfecting their seeds. Monsanto doesn’t care about tourism. They would just as well get rid of everyone and take over all our lands and control the World’s food supply. Will tourists still come to Maui knowing what is happening here? Will the hotels wake up and see it’s too late and they should have gotten on board and spoken out? Is everyone asleep as Monsanto takes control and poisons Maui?

    The 9th Circuit is probably the most likely appeals court in the entire country to reverse the Maui decision. Sounds good, except it won’t matter in the end, because Monsanto will appeal, and the Supreme Court will reverse the 9th Circuit. SCOTUS would probably welcome a case like this, to put a stop to local anti-GMO efforts. But don’t worry, its ruling will sound impeccably reasoned and impartial.
