GMO wars: the right of people to nullify fascism

Consider the two counties in Oregon (Jackson and Josephine) that banned GMO crops.

Consider the measures in Maui, Kauai, and the Big Island of Hawaii that blocked further development of GMOs and the spraying of toxic pesticides.

They all won.

Then the state government of Oregon, in order to stop the trend, passed a law forbidding counties from unilaterally banning GMOs.

In Hawaii, a federal magistrate struck down the victories in Kauai and the Big Island, on the basis that such matters are controlled by state law. If he has his way, he’ll render the same opinion re Maui.

In each case, the determination is the same: state law takes precedence over county law.

Translation: the state can decide what its own powers are, and then enforce them. The courts and judges will fall into line.


This was exactly, on a higher level, what the US Constitution was framed to avoid. That document ceded enumerated powers to the federal government; all other powers were reserved for the individual states or the people.

Therefore, the individual states could nullify federal laws or mandates that exceeded those enumerated powers. Nullify; strike down.

By analogy, the individual states can’t arbitrarily take on powers and bend counties to their will. Counties can nullify actions of state governments.

The people (e.g., voters) aren’t supposed to be androids who, having ceded a certain amount of power, simply stand back and watch the passing show, as governments gather more and more force to themselves. The people can intercede.

Nullification may seem like a long shot—but consider that other legal efforts have, so far, in Hawaii and Oregon, failed to sustain the ongoing right to ban GMOs. Failed.

Shifting the argument to the more fundamental issues I’m raising here challenges all parties, all laws, all crimes, all criminals.

Otherwise, I assure you, the states and feds will simply continue to assert they have the power to side with Monsanto, Dow, DuPont, BASF, Syngenta.

They’ll say, “Counties can’t ban GMOs. It’s a matter for state law.”

And again, what is state law? The state declaring it has the power to do what it wants to.

Most lawyers, if consulted about nullification, will says it’s useless and/or illegal.

They don’t realize that the big picture dictates asymmetrical battles—-smart court filings, frivolous court filings, and “awakening” filings such as nullification.

ALL legal battles on this GMO issue should form the background and the occasion for relentless publicity, exposure, scandal, pressure, and so on.

Victory isn’t found inside the system, but it can be found using the system.

Unless you’re devoted, move by move, to playing a game that’s already rigged against you. Then you lose.

  1. What can we do as individuals? Signing petitions and attempting to educate local citizens does not seem to make a difference. Please help!

      handed out info at the markets ?
      drawing them into conversations about this ?

        Salome – Thanks for your response. I feel the best use of my experience and knowledge is to put into teaching efforts, and I shall continue to work on that approach. I volunteer at the local Farmers Market at every opening, and have also joined their Board of Directors. I continue to push for organic foods (ready to eat meals) at the Market, as well as organic produce. We have a good selection of the later. Little or none of the former. Door-to-Door is too intrusive for me – I resent my free time being taken up without my consent; even the interruption is annoying.

        These corporations are ONLY serving their bottom line. The only way to change that is to quit buying all manufactured food in the grocery store. To grow your own food or buy from local farmers. Anything short of their declining profits will not change the practices of the Big Food Industry. The smaller companies are subsidiaries of the larger ones. Most ownerships leading up the chain to the Rothchild family interests. How does one fight that machine? They own most of the governments in the world, including ours. We do not have democracy, not even a Republic anymore. We are stuck under the reign of a corporate fascist plutocracy. These people eat Senators & Presidents for lunch. I’ll be looking for my local farmers because I’m very untalented in the growing my own department.

        They will incite a racewar or civil war on us all before they give up. I’d like to believe we can force them to “serve us.” They have legally given corporations “personhood” and labeled the corporate government contributions “free speech.” Our Representatives listen very well when they are sweet-talked to by the corporations. They will not bite the hands that feed them.

    And so… Perhaps the best solution is to quit contracting with this system and work towards a better solution. Lose the name, accept all funds as lawful money (not legal tender) which is not taxable… And share awareness of better ways to structure Humanity on this planet.

    Very important to note the main context Jon points out here! According to our constitution the power lies in the people and not in the people the people elect to represent them! This may sound redundant or confusing at first but it is not.

    The power first applies to the individual person and then in the city officials. Next it applies to the county officials we have elected to represent us at that level. Finally within each individual state the power goes to the State level where our elected officials represent us at the national level via our Legislators and Senators. The Governor is responsible for coordinating and alligating the wishes of people throughout the various counties of their state with their wishes to be represented at the National level.

    The Governors and President do not have individual powers to override the wishes of the collective of individuals…..period. There was a safety for this put in (our Legislators and Senators) to prevent a rough President from taking over and becoming a dictator! That has failed the American people and this is why every American individual has a right and in truth (by law) must STAND up and declare our government null and void…..period! If you for one second dought my words then you do not know your own Constitution and should be ashamed!

    We owe it to our children and their children ETC to STAND up and uphold the law of the constitution in order to preserve it and our Republic for all times! It is the single most important thing as an American that we have to do every day of our lives to protect our freedom to live where we want, worship as we believe, speak out anytime and where we want and most importantly to create or dismiss laws upon a majority vote.

    The majority of middle and lower class people have either not read and understand the constitution or are just simply satisfied with being ruled as the upper class and their government provide for! Some people call this slavery I simply call it stupidity out of laziness to become involved.

      Thanks, Mike, for a great reply. I have taken history classes about the Constitution, and also the Declaration too. The distance between those well thought out exercises and the reality of what we have to cope with now is far. Even in our small town of 15,000+, it is like wading through a bog of ignorance/self interest to try to get the city to ban the nasty herbicides and insecticides. We are working through a Transition movement, but they are focused on reducing fossil fuel energy instead of the bigger picture of trying to outwit industrial agriculture and return to sustainable agricultural practices. We have a local petition circulating which focuses on restoring the power of the citizen over local government (forget the title, will research and add later.) It has been drifting around for months.

      This is exactly what I was thinking, but you said it better than I would of.

      Governments at all levels, are here to serve us, not to serve the big corporations or themselves, but to serve the people.
      They are servants, not kings nor dictators… servants! They don’t seem to understand that, but we do.

      Therefore, we can remind them of this evidence and fight it in the Courts and win!

      and goodness has absolutely nothing to do with the OUTRAGE THAT IS BUILDING UP within these United States, as it is nothing beyond seeking justice and redress of grievances. IT HAS BEEN OBVIOUS THAT the elected whoredom couldn’t care anyless about the Constitution, state’s rights/10thA, etc.

    So what needs to be done? If there is something we, the people can do, why aren’t we?! We sit here preaching to the choir day in and day out! Are there any lawyers ready to take on this endeavor? I heard that law students got $40 to stand in the front of the line to get into the hr4423 (the Dark Act) hearing on Wed.. Zen Honeycutt, who founded Moms Across America went from Calif. and didn’t even get in. Hardly, if any, anti-GMO people got it. She used the Freedom of Information Act and got over 100 studies that the FDA based their decision on that GMOs are safe and some were 96 hrs. long, 96 hrs.! Insane!
    So, if there is something we can do (and it sounds like there is) let’s get the ball rolling. Time is not on our side!

    STOP SUPPORTING GMO’S by BUYING them! We keep bitching about these corporations when in FACT we turn around and BUY their products! BOYCOTT all these corporations! Including Big Pharma. , Big Agra, Telecommunications, Giant retailer’s like Wall-Mart, Big Banks ect.
    BOYCOTTING is the POWER OF THE PEOPLE!
    Okay yeah you have to do some research and find out which products have GMO’S, but that is way easier then trying to get the laws changed when these corporations OWN our government!
    BOYCOTTING IS THE POWER OF THE PEOPLE!,
    Because guess what– we are the guilty ones who GAVE THEM THIS POWER!
    But we know better now!

      Hi Cindy;
      Unless you have access to organic everything, (ie: grown yourself, home made pasta, etc.) you cannot avoid GMO’s. The Food Industry admits that GMO’s are contained in almost ALL grocery products. They have no intention of labeling GMO products & even less intention of ceasing the production of GMO’s. Rothchild’s are at the top of the chain in the food industry & the drug industry. They profit making us sick with their GMO food, then they profit with Rx’s when the food has made us sick enough. We all need to start growing our own food & barter with neighbors.

        First off, your right there is LITTLE we can buy at the store, I would guess about 1%. I my self, eat a very basic diet of pretty much ALL organic. All processed foods are GMO’d. So yes growing your own, COOKING from scratch is mandatory! I also try to SUPPORT our organic farmers.

        Speaking of Big Pharma, there are NATURAL products that work way better (example: Garlic & oil of oregano). The ONLY thing from Big-Pharma that I feel is necessary are the antibiotic’s — if you have an infection.

        Meditation and SELF HEALING (the body is amazing — focus your mind, and think the words healing mode), I also massage my finger’s at the same time–puts my body In proper alignment & feels wonderful! You will know when your doing it right.
        With time and practice your body will slip into this healing mode immediately! We naturally have the ability to heal ourselves!

        On telecommunication –yes the computer is very valuable for research NO-WIRELESS ITEMS EVER! Wireless destroys the function of our cells! So NO-CELL phones, or Smart Meter’s! But as you can see, the industries make us feel we can’t live without these things–NOT TRUE ,I DON’T HAVE A CELL PHONE and NEVER WILL.
        Detoxing the body is ALSO important. Walking in fresh air, sweating, movement of the body, clean water if you can, Music and dancing- things that make you happy! Positive energy.

        And probably most important–UNDERSTAND HOW WE ALL ARE BEING MANIPULATED AND UNDER MIND-CONTROL! Mind-control can not be effective if you are aware they are using it on you!

            I want to remain open minded about colloidal silver—however—I had a dog with a skin infection—and it did not help—any. Too late I realized he needed a vitamin E solution on his skin. I recently had a fairly severe infection (internal) which I fully resolved in 6 days by taking garlic, which contains allicin, a compound that bacteria/viruses cannot develop resistance to. Garlic additionally contains sulfur, a powerful anti-inflammatory. As supplementary to garlic, I took ascorbyl palmitate (best form of vitamin C), zinc, B-vitamins and beta glucan, immune system builders. I later realized the infection would have faded faster had I upped the garlic dose (tablets—not even fresh garlic).             I’ve personally found Grapefruit Seed Extract to be the most powerful natural antibiotic out there. It is sold in concentrated liquid & capsules. I rarely need an RX antibiotic since I began using the GSE.

        Forget the word ALL. Just avoid the obvious…cereals, snacks, GMO flour.
        If you spend your money wisely on more choice soups and things, you will also lose weight and be healthier.
        I have no garden or much money, but stock up on Amy’s soups and Matt’s orange juice and such. The worst gmo is bought in fast food and empty calories anyway. Go for it…and never buy it for family members. They will adjust fast. Like other withdrawals, it’s hell, but won’t kill them. They’ll brag about you.

      Boycotting is right at the top of my list of pro actives; just below sticking to local, whole and
      organic foods. Medications are not quite that simple for me, and telecommunications is my best way of keeping well informed.

      I couldn’t agree w/you more, Cindy, but here’s the deal. Boycotting isn’t going to stop gene drift from contaminating our entire food supply eventually. That is why they need to be banned! Russia just did it and so should we!

    Over the past 100 years or so there has been a massive expansion of federal power. A lot of it has been done with federal court decisions that expand the interpretation of the Constitution, a little bit at a time. Those decisions become part of the law, and form the basis for future decisions, which are then expanded a little more. The framers of the Constitution would be beyond shocked at the amount of federal power today. Maybe.

    Judges can and do control people who step too far outside of the paradigm by imposing massive monetary sanctions. All it takes is a plausible argument for doing so, and any clerk or opposing attorney who can’t come up with a plausible argument is in the wrong business. Attorneys for monied interests will make everything as onerous and time consuming as possible. It creates billable hours for them, and might help break the other side.

    People want to believe the judicial system is above the corruption of the psychopathic cabal that is infesting the other two branches of government. It’s not. Replacing Judge Kurren in Maui is not going to change that. He’s just the most visible symptom of a systemic problem.

    History has seen a handful of famous dynamo attorneys. They always have plenty of money from somewhere to swoop in and devote months of their lives to oppressed underdogs in high profile cases. Like magic, hoards of fawning media hang on their every word. They’re like Edward Snowdens of law.

    Meanwhile, hundreds, thousands, of William Binneys of law fight for the unknown who are getting screwed by the system every day. No one notices, and no media cares. They don’t wear cowboy hats in court, because most judges won’t let anyone in the courtroom with a cowboy hat. I guess they just don’t have the right star appeal. Or something.

    I watched the December 2014 House subcommittee hearing about GMO’s – it was appalling. The House Representatives questioned the FDA Director & big food Executives about GMO adverse effects, they all lied through their teeth & testified that they never heard about any study that indicates GMO’s could be harmful. The Big Food Exec’s were very indignant in their responses to the House committee members. They acted annoyed at having to participate in the dog & pony show. It ended with the “House Representatives requesting the Big Food Exec’s to write an acceptable bill about food labeling.” They had already all commented that they would not label which grocery products contain GMO, as they stated, “almost every product in the grocery store contains GMO.” It was so obvious that these House members were owned by the Big Food Industry. It’s truly disgusting to watch them try to question but being certain not to offend them.

        You missed the best part at the end. Where the Congressman “asks the food industry people to write the bill” about how to address the GMO issues. Our elected Representatives truly do nothing more than get themselves re-elected.

    Do you mean the one I’m circulating? That’s the petition of Living Democracy-Skagit to the County Commissioners asking them to adopt a Community Bill of Rights for all Skagit residents (including non-citizens) to protect the Skagit River, beaches, farmlands, workers, neighborhoods from excess intrusion, asking for transition to a carbon-free economy, guaranteed full rights according to the UN Declaration of Human Rights, and declaring that persons must take precedence over corporations.
    It’s meant to challenge the corporate takeover and keep out unsustainable corporate projects (like Tethys was).
    We had a real close call when a corporate conglomerate attempted to get a water bottling plant installed right next to one of our estuaries.

    A reminder: You do not have to be a lawyer to litigate in a courtroom. Law study groups need be started, as we are doing in our area. More are being educated to join in court and use the point of the legal system which has been co-opted by special interests. Rulings stand becuase very few outside the legal system understand the options. And it is correct that licensed lawyers are officers of the court, and therefore, reluctant to challenge a system that supports their quest for power?money? prestige? No, that can’t be right…

    There is a state park nearby beloved of campers and families. But in 2006 it was ripe for picking to make real estate deals for senior housing near a gated fiefdom and golf. I got the address from the ranger and did homework. It smelled of the usual suspects drooling over the loot.

    Inside the park is a long trench of Civil War days where the soldiers fell back for sleep, letters, and card games…it’s full of ghosts and tales. I wrote Atlanta and told them our park had these trenches…that any attempt to sell off our park would be met with serious and publicized resistance from the Civil War enactment people and history people.
    Mentioning a local entertainment newspaper run by a friend…a guy with kids who love the park…
    I wrote neat, handwritten personal letters with no anger or threats, beyond publicity.
    The next time my family went there the ranger told me the plan was mysteriously dropped.
    The park is still there with it’s Confederate trenches and trails.

    The point is that petitions aren’t enough…corporations dismiss those as hippy crap. Personal letters in real envelopes show real caring and investment. And, as Jane Goodall says of her big game hunter comrades, support can come from very unlikely places.
    Support for the non-GMO effort can come from 5 star restaurants, chefs, their magazines, and many others with no connection to the environment issues.
    A petition with TEETH would say: “I, Jon Rappaport, promise to avoid GMO foods in every way and encourage others to do the same.” Then sign and do it.
