DID PROP 37 REALLY LOSE OR WAS IT VOTE FRAUD?

Hold your horses.

On election night, not long after the polls closed in California, the announcement came out: Prop 37 was losing. A little while later, it was all over. 37 had gone down to defeat.

But is that the whole story? No.

As of 2:30PM today, Thursday, November 8th, two days after the election, many votes in California remain uncounted.

I tried to find out how many.

It turns out that the Secretary of State of CA, responsible for elections in the state, doesn’t know.

I was told all counties in California have been asked, not ordered, to report in with those figures. It’s voluntary.

So I picked out a few of the biggest counties and called their voter registrar offices. Here are the boggling results:

Santa Clara County: 180,000 votes remain uncounted.

Orange County: 241,336 votes remain uncounted.

San Diego County: 475,000 votes remain uncounted.

LA County: 782,658 votes remain uncounted.

In just those four counties, 1.6 million votes remain uncounted.

The California Secretary of State’s website indicates that Prop 37 is behind by 559,776 votes.

So in the four counties I looked into, there are roughly three times as many uncounted votes as the margin of Prop 37’s defeat.

And as I say, I checked the numbers in only four counties. There are 54 other counties in the state. Who knows how many votes they still need to process?

So why is anyone saying Prop 37 lost?

People will say, “Well, it’s all about projections. There are experts. They know what they’re doing. They made a prediction…”

Really? Who are those experts? I have yet to find them.

For big elections, the television networks rely on a private consortium called the National Election Pool (NEP). NEP does projections and predictions. Did NEP make the premature call on Prop 37? So far I see no evidence one way or the other.

NEP makes some calls for the television networks, but NEP is composed of CBS, CNN, FOX, NBC, ABC, and AP. It could hardly be called an independent source of information for those networks.

NEP has AP (Associated Press) do the actual vote tabulating, and NEP also contracts work out to Edison Media Research and Mitofsky International to do exit polls and projections based on those polls.

Edison Media Research did the exit polls in the state of Washington for this election. How? They surveyed 1493 people by phone. Based on that, I assume they made all the projections for elections in that state, even though there is no in-person voting in Washington, and voters can submit their ballots by mail, postmarked no later than election Tuesday. So how could Edison know anything worth knowing or projecting on election night?

Both Edison Research and Mitofsky were involved in the 2004 election scandal (Kerry-Bush), in which their exit polls confounded network news anchors, because the poll results were so far off from the incoming vote-counts.

Edison and Mitofsky issued a later report explaining how the disparity could have occurred; they tried to validate their own exit-poll data and the vote-count, which was like explaining a sudden shift in ocean tides by saying clouds covered the moon. It made no sense.

So if NEP did the premature Prop 37 projections that handed 37 a resounding loss, there is little reason to accept their word.

We’re faced with a scandal here. An early unwarranted projection against Prop 37 was made, when so many votes were still uncounted.

Those votes are still uncounted.

Why should we believe anything that comes next?

  1. Is there available some type of legal recourse to address proper counting and reporting of the actual voting results?

  2. mamaknock says:

This is a very important issue to the public health system and right to know, we defiantly need ot follow up on with our local and state officials. Passage will effect our entire country. We cannot accept the governments lack of concern and let them cover this over in their effort to protect their “special interest” companies.
Squeek loud enough and we will have to get the grease just to shut us up! Never give up!

  3. john polifronio says:

Well, Mr. Rapaport, we need an answer here! You’ve not clearly and definitively told us whether the remaining uncounted votes will be counted, and when, and how, and by whom. Is this a joke? Are you serious? If not, we have a scandal of monumental proportions in evidence here. Please give us a response.
    thanks

The Secretary of State publishes the unprocessed ballot numbers. Here: http://yubanet.com/california/Over-3-Million-of-Unprocessed-Ballots-in-California.php

A little more homework would even detect the cause of these 3 million ballots not being counted. Vote by mail or absentee voters turning their ballots in on election day – thus completely defeating the purpose of voting at home.

Read your story posted by Mark Crispin Miller. Also read Ocean Roberts Alter Net story ‘Did Monsanto Trick California Voters?’in that story is a link to an ABC poll that says 93% of Americans want to know if their food is genetically engineered.
Will no one challenge this outcome?
In my community Dow Chemical and BASF are building huge GMO plants to do business in the USA. BASF cannot do business in its’ home country, Germany.
Assuming that you are right about our political system, this may be the most important issue to come out of the election.

we haven’t heard anything about acorn for years so there is no longer any vote fraud
If there is any question at all just ask Barry I am sure he will tell you there is no such thing as vote fraud.
why do you want to know whats in your food? you need to worry about paying that new state tax and turning in your guns to Feinstein.
As soon as you adopt a more European way of life they may let you get labeling, because over in Europe the didn’t want labeling and the big companies complied.
I was born and raised in the golden state, I used to be proud to say that.
To my friends and family still there you have my sympathy, my empathy.
To the minority true patriots of California keep up the good fight.

Though I would love to see 37 win I understand statistical sampling and I think the projections are probably well within any reasonable margin of error based on the sampling size…it is possible that the votes counted represent some strange sampling anomaly but I doubt it…unfortunately.

Hey thought you might like this…it is a link to the total number of uncounted ballots as provided by each county on the California Secretary of State website.

The totals are staggering… 3,295,045 uncounted votes!! WOW!

Most counties have reported these figures as of 11-08-12

I have started a petition with change.org to encourage the USDOJ to prosecute the No on Prop 37 Committee for fraudulently using the official FDA stamp (logo) and titles in advertising to deceive the voters in California voting on Prop 37 (label GMO’s in food). Change.org has had some amazing results!

We can NOT allow or tolerate the blatant misuse of Federal Laws at the benefit of or detriment to anyone! PLEASE SIGN so we can send a message to Monsanto and other corporations who use illegal and deceptive tactics!

Please encourage others by sharing on facebook or blogs you may post to. Also, follow the links in the petition so you can see for yourself. Use the following link and sign the petition… THANK YOU!!

this is an except taken from the carighttoknow.org website…

“Leading consumer groups revealed a long list of documented deceptions of the No on 37 Campaign, including blatant misrepresentation of the positions of leading science, professional, academic organizations and government agencies as documented below. This pattern of fraud tells the true story about how far the world’s largest pesticide and junk food companies are willing to go to keep American consumers from having a choice about genetically engineered foods. Opponents of Prop 37 have been caught red handed:”

as a footnote in less than a day and a half I have over 1060 people sign the petition

I ask again, when will we see a completion of the prop 37 count, that includes the over 3 million uncounted ballots? How long will we wait for an answer to this question? This is an incredible outrage that must be met head on, by all of us. Where is the Yes on 37 leadership?

  20. JC Lincoln says:

The FIX was in. I smell a big lawsuit. One that could take down MOnsanto.

  21. thinker says:

Prop 37 reported to have failed on Nov 6th but consider the
    following:

Official final report of all ballots accounted for is Nov 9th.
    100.0% ( 24,491 of 24,491 ) precincts partially
    reporting as of November 9, 2012, 5:59 p.m *

10,188,977 Total Ballots Cast in CA

    Ballots Cast for Prop 37
    4,569,271 47.0% Yes
    5,152,927 53.0% NO

    Simple Math
    (10,188,977 total votes) – (5,152,927 53.0% NO) = 5,036,050
    (5,036,050 remaing votes) – (4,569,271 47.0% Yes) = 466,779
Number of people who possible did not vote on prop 37.

Is there a report of the number of discarded ballots
considered soiled per county or per precinct?
Is there a report of the number of discarded ballots
considered invalid by unverified signature per county or per
    precinct?
    {
    Orange County
    Votes Yes %
    365,846 40.1%
    Votes No %
    546,057 59.9%
    }
Total Number of ballots cast OC on prop 37 911,903
Total Number of ballots cast OC 952,111
40,208 ballots cast in OC who possible did not vote on prop 37.

If 116,877 and plus one voters were some how screwed out of
voting then we have a case for voter fraud. Only 116,879
additional votes were need to pass prop 37.

Now just looking at OC electorate alone why didn’t those
40,208 people not add a Yes vote to push prop 37 victory?

Therefore 34% of the votes need to pass prop 37 could have
come from Orange County. Where OC expirenced a low turn out
rate of only 56.6% This might validate being suspicious of the OC Registrar.

  22. thinker says:

    “Provisionals Left to Count.”

Total estimated number of provisionals to count: 78,394
    Source:
    Cited November 10th 2012 3:14AM

78,394 Orange County Voters got F*over and given an
    uncounted provisional ballot.

Let see here voters F*over + 40,208 possibly clueless voters
equals 118602 possible additional votes for Yes. Now only
116,879 needed for a pas so do the difference yields us 1723
more votes than necessary to pass prop 37!
[Note: this analysis is not even statewide]

    TL;DR
Given there needs to be only an additional 116,879 more yes
votes to pass prop 37 and 40,208 OC voters “skipped” voting on
the prop. Therefore 34% of the votes need to pass prop 37
could have come from Orange County. Where OC experienced a
    56.6% low turn out rate.

[…] I don’t get it – I don’t live in Calif. I think it was Stalin that said “it doesn’t matters who votes, what matters is who counts the votes”. Wellllll? this comment, by the way, is totally based on your information being accurate and unbiased.

    not in a million years!

  26. Steven Yale says:

1st the election has not been CERTIFIED !!!!!!2nd The required 2nd count was not to be released untill after the date of this article !!! 3rd there are many provisions in the laws for recounts!!! A good article but not complete or focused on many factors. Projections are based on two things ,exit polls, and the voting history of key precincts!!! The projections have proven to be accurate enough to be used but the election is not Official until it is certified! The President is not Elected by the popular vote! The Electoral College has yet to meet!

  27. Tom says:

Jon, why don’t you post the phone numbers that you called so everyone can call them and put pressure on them and post those numbers on their facebook sites and email them to media and news orgs and we can make a difference with this. But, what are those phone numbers you called to find out what you found out?
    Thank you.

to be clear in the EU we don,t want GMO,s and i know that some of the leading states of the EU i.e. germany and austria (where i live actuallay) have strict rules respective to GMO,s . Consumers in the EU are concernt about GMO,s and they don,t want (Monsanto, Dow Chemical, Bayer and so on in there food) to consume GMO,s . Global GMO labeling is a crucial issue that has to be carried out, because if people know a product contains GMO they won,t buy it is that simple. The corporate gangsters know that fact very well and for that reason they don,t like this pioneering task in california that can serve as a precedence in other states or north america wide. But think as well that our debt and compound interest rates based monetary system is the foundation to the dectruction of the whole planet earth. This is because of the system intrinsic economical growth necessity to pay back the interest and compound interest rates for debt. Unlimited exponential economical growth is not feasible in a limited world with limited resources and this has nothing to do with socialism, communism or free markets it,s just mathematics. I agree that government has to be reduced but first with a reliable framework called sustainable monetary system.

My husband and I have both encountered many people here in CA who voted against 37. Why did they vote NO? One, for example, said she was for it until she starting doing “more research”. Another said she didn’t want “more government interference in our lives”. Some just followed the voting guide put out by the newspaper. In other words, there may have been fraud in the counting of votes, but there are also just a lot of ignorant people in this State willfully voting against their own best interests.

    How do we fight this????

Paper ballots hand counted with an unbroken chain of PUBLIC CUSTODY, without officials interference, using false flag terror, or exploiting local law enforcement against poll watchers and whistle-blowers..

In short I’m not sure the apathy in the US can be overcome. Officials really have things screwed up. With one thing tied to another.

You have to get rid of the electronic vote tabulation devices.
You have to get rid of registered voter electronic poll books.
You have to get control of the FCC from POTUS and make it public chosen.
You have to then place FCC engineers who are working for the public interest instead of commercial fascist interests.
Then you can make FCC force stations to make their public file a lot more accessible and make it know that complaints in the public fie will get the stations frequency allocation yanked. At that point you have re-gained control of the media. When CBS news is no more important than a guy with a miniDV on a public access show. Problem is the mission statement at FCC was changed, and (the Free Stuff Army) people think freedom of speech is the right to buy a cheap mobile phone. Go back to the FCC’s original mission statement. A lot of this is going to have to be about education, history, and the dangers of letting this continue.

Africa for Africans, Asia for Asians, White Countries for Everybody
    Annihilation by Assimilation

Every white country on earth is supposed to become multicultural and multiracial. EVERY white country is expected to end its own race and end its own culture. No one asks that of ANY non-white country.

The Netherlands is more crowded than Japan, Belgium is more crowded than Taiwan, but nobody says Japan or Taiwan will solve the RACE problem by bringing in millions of third-worlders and assimilating and intermarrying with them.

Everybody says the final solution to the RACE problem is for EVERY white country and ONLY white countries to bring in the third world and assimilate with them.

Immigration, tolerance, and especially assimilation are being used against the white race.

All this immigration and intermarriage is for EVERY white country and ONLY white countries.

Anti-white is called anti-racist, but it leads to the disappearance of one race and only one race, the white race. The real aim of anti-racism is to wipe out the white race or make it a minority anywhere it exists.

    It is genocide.

  37. Wily says:

Are you talking about prop 37 (Ca)? Of coarse it was voter fraud gone wild! Why did the current occupier not get removed in 08 by the US marshal(s)? Answer to both questions may have a lot to do w/agenda 21. The world has maybe 2000 families of super rich elites who sold there souls (Sa tan) for a vapor of time for $$$ gain who are on a power control trip and will stop at nothing to destroy America and the the elders because of their wisdom while turning everyone else into lemmings! Karl Marx would be proud! Most people cannot handle the truth, it may not be to late but w/all the issues slamming us today we must truly educate ourselves and do not slam those who might be willing to help. As Americans, we have to hang together, or hang separately, yes, I took the words right of of Franklin’s mouth, you know Ben, he was one of Americas Founders, brilliant men, most of the guys had accomplished by the age of 30 what very few others throughout their whole life. Those who do not know (American & global) history will allow it to repeat. I’ve often wondered years ago just how ‘they’ would pull it off here in America, Karl’s manifesto pretty much explains it, especially of the close to 20 extra’s “do’s” added to the original 45!

People that supported this bill should spend more time funding legitimate research that supports the opinion that GM products are harmful, and less time hatching conspiracy theories as to why the bill was unsuccessful. You may not like to hear this, but many people view your group the same way they view people that deny climate change or people that deny we landed on the moon. The bulk of the scientific community is telling citizens that you guys are full of it, and the ‘studies’ that you keep passing around as evidence that GM products are dangerous don’t belie their take on the situation. Spend the next few years getting your ducks in a row, and come back when you have a proper study showing the rest of us that this labelling is necessary. You may think it ‘ignorant’ that a person wants evidence of the efficacy of such a proposition before voting to pass it into law, but that really couldn’t be further from the truth.
