In a previous article, I asked: on what legal basis must US (and other nations’) legislators obey a code of silence about the Trans-Pacific Partnership treaty?

They can only read partial drafts and summaries of the trade pact, and then they can’t tell anyone what they’ve read.

It’s a version of “pass the bill and then you can read it and find out what’s in it.”

No problem, except a significant chunk of 12 nations’ futures are riding on the details of this treaty, which, from the leaks we’ve seen, is a boon for mega-corporations and a nightmare for populations.

In the US, Senators, who must vote for the treaty in order for it to pass, go into sealed rooms and look at text—excerpts from drafts, summations—and then emerge, knowing they can be arrested if they open their mouths to anyone.

A source close to the treaty negotiations has given me the legal basis for this law of omertà:

National Security classifications that designate levels of secrecy for government data.

What? That old justification?

Yes. The relevant laws and regulations are long-standing. They are enforced by the Department of Justice. Various levels of classified data are set by agencies within the Executive Branch.

I asked this source (he has read TPP draft-sections and summaries) what the punishment would be for revealing what he knows.

He laughed. “I’m not about to find out,” he said.

Applying “Secret,” “Top Secret,” or other classifications to a treaty that must be voted on, in order to become law, is a unique situation.

It’s one thing to say a federal scientist can’t publicly publish details on how to build an H-bomb. It’s quite another thing to say US Senators can’t reveal, to the American people, what they’re voting on.

There is no Constitutional basis for such an assertion. In fact, it’s a direct violation of the Separation-of-Powers principle.

By assigning National Security secrecy-status to the details of the TPP, the Executive Branch is arbitrarily muzzling the Congress.

We’re witnessing a stunning farce.

Knowing they’ll be arrested, Senators should be spilling details of the TPP to anyone who’ll listen. They should be intentionally creating a Constitutional crisis.

They should be blowing the whistle on the covert attempt to put all Americans under the gun of a secret treaty.


The Matrix Revealed


Oh, but wait. That would be a Senate with conscience, and with balls. Not this menagerie of sold-out puppets and twits and party hacks and drunks and shysters and blackmail bait.

That would be a Senate out of some old Hollywood movie, which as a body suddenly rises up in a moment of great decision.

Obama has the chutzpah to tell dissenting members of Congress their criticisms of the TPP “aren’t specific.” He’s baiting them and tickling them, because he knows they’re not allowed to be specific about what they know.

Is there even one Senator who will accept the dare, who’ll step forward, in front of cameras, and recite everything he knows about what’s in the TPP?

If the FBI arrests him, that would set the stage for a fantastic courtroom scene.

We could use a good Constitutional crisis.

It could create a sudden acceleration of fizz in the rotting decaying swamp of Washington DC. It could loosen a few tongues, and a few more choice stench-ridden secrets could come spilling out.

But oh, there I go again, talking about a fictional Senate, one that would require men and women, not ruined shells.

Not hideous caricatures, pretending to be honorable by obsequiously obeying “see something, say nothing.”

    AMY GOODMAN: I want to just ask one little example: “Buy American,” the whole push to try to buy things in the United—that are made here, because it would mean more U.S. jobs, etc.—how would that fit in to TPP?

    LORI WALLACH: So the way that that works is TPP, amongst its 29 chapters, only five of which have anything to do with trade, one of the nontrade chapters is a chapter about procurement, government procurement rules. And in that chapter, the requirement is that the U.S. government treat bids from any company in any TPP country identically to how they would treat a U.S. company’s bid. But Buy America and Buy American, two laws, the first one from 1934, requires you give a preference to a domestic company, so that when we’re spending our tax dollars, instead of offshoring our tax dollars, we’re reinvesting them in our communities to create jobs and also, by the way, to create innovation. So, like the CAFE standards, that are now normal, the fuel efficiency standards for cars, that was first a procurement condition; so the Renewable Portfolio Standards, the renewable energy standards that are now part of government procurement—that’s how you create a market using the government funds for a behavior you want the private sector to shift to.

    Great policy tool, great job creator, super—except, under TPP, we’d have to give a waiver to that preference. Any company in any TPP country, so even ones that aren’t from those countries—Chinese state-owned enterprise firms in Vietnam—would have to be treated the same as a U.S. company and get all of those government contracts. And that’s also the same rule that undermines all the Buy Local preferences. So to the extent—you know, for instance, a lot of school districts have done rules that say, “Let’s buy local food from local farmers. Let’s not have a big multinational company ship our vegetables a thousand miles away when we have the ability from right here to produce and procure.” Those would also be violations. You have to treat the foreign company the same, give them the same access, as you would any domestic company. And if we don’t change our laws to meet those rules, we would face trade sanctions until we do.

      Theodorewesson: The Trans-Pacific Partnership agreement will pass because the international corporate elite that runs things behind the scenes wants it to pass. The TPP will be supported by Democrats and Republicans — no matter how damaging the TPP will be to the vast majority of Americans and no matter how much it may be opposed by the vast majority of Americans — because Democrats and Republicans all play for the same team and are all paid by the same people. They are not ideologically motivated; they do what they are told.

      Capital has no country. The United States will be ruined, but the international corporate elite that runs things behind the scenes has no allegiance to any country. Destroying the United States is to them like causing a depression in Thailand. The international corporate elite — and I’m not talking about the “1%”, more like the 0.0001% — always come out on top, no matter what happens to the rest of us.

      The sooner we realize that our politicians are willing servants of the corporate elite and promote an agenda hostile to the interests of most Americans, the sooner we can begin to make the large-scale systemic changes necessary to create true self-governance.

      If we sit around waiting for “our party” to get back in control and make things right — or wait for the next political charmer anointed by the corporate media as the “outsider” who will at last take us to the promised land — nothing will change and those really in control will continue to be way ahead of us.

        It will be interesting to see if “waking up” will prompt a REAL declaration of war and what “form” it will take. Once “known” 0.00001% become ever so vulnerable. They can only stay “hidden” for so long. A new batch of Star Kids are being produced each with a wide open third eye. Those vaccines will only help improve their “vision”.

    It seems the TPP is perfectly positioned to deflect all criticism, by ensuring that people only criticize the process, the secrecy, not the document, until the agreement is in place. It’s an interesting technical advancement in the technology of ‘democracy’. It’s technology, not democracy.

  6. I don’t know why more organizations aren’t up in arms over this? AARP should be all over this since $700 million will be cut from Medicare. Spread the word to everybody who calls a Republican Representative to oppose the TPP to say they oppose Obamatrade since they hate everything Obama! Fight on and vote BERNIE 2016!!

    Yes, Congress is failing us by Not disclosing what’s in the TPP–how can the text of a putative law possibly be kept a secret from the people! We are clearly not a functioning democracy.

    What outrages me the most is that there is hardly a whimper of serious and LOUD dissent from ANYONE in Congress or the MSM over this. For the COWARDS in Congress to even go along with this blatantly illegal act is naked proof that the American People have been sold out at the highest levels of government. They should be telling Obama not to darken America’s doorstep with this garbage.

    Speaking from a politically selfish standpoint, this would be the perfect scenario for some egotistical, self-serving ham from the House or Senate to make a name for him/herself and defy the so-called “national security classifications”. You couldn’t BUY that kind of publicity.

    Come to think of it, If one of these so-called “presidential candidates” really wanted to separate themselves from the pack, this would be the time.

    But then again, the American People probably wouldn’t care anyway, because TO CARE, one has to be aware of what’s going on in one’s country in order to realize what the stakes are in all of this. That’s just not the case here in Zombieland USA.

    Different “stink”, Jon, but wasn’t America “stonewalled” into Iraq 2? From what I remember your illustrious Senators were blind, deaf and dumb to criticisms levelled at “evidence against” Iraq. Charismatic Canadian historian, Michael Parenti, even coordinated a protesting contingent which included the Irish ex Prime Minister and other notable patrons. The din did not penetrate the silence.

    All that depleted plutonium dumped on Iraq, with devastating impact on the health of the people they were supposedly “supporting”, courtesy of Clinton, was wiped from the memory banks.

    “President [Barry Davis] will veto any TPA bill that contains this [global currency markets regulation] amendment.     In the end, 41 Republicans and 10 Democrats defeated the amendment [to the TPA legislation], which was considered the last major hurdle to securing Senate passage of the [Trade Promotion Authority] legislation.

    On the final roll call [for the actual trade Promotion Authority legislation itself], five Republicans joined 32 Democrats in opposing the Trade Promotion Authority legislation — an odd collection that ranged from Minority Leader Harry M. Reid (D-Nev.) and his top two lieutenants to staunch conservatives such as Sen. Rand Paul (R-Ky.). “Congress is forgetting its duty: to improve jobs and wages for Americans,” Sen. Jeff Sessions (R-Ala.), one of the most conservative senators, said in a statement.

    House Speaker John A. Boehner (R-Ohio) has said that the TPA bill will come up at some point in June, after his chamber returns from a 10-day break that began Thursday (5/21/15).

    [The now] chairman of the [House] Ways and Means Committee, [Rep. Paul Ryan (R-Wis.)], is leading the push to secure as many votes as possible from the Republican side of the aisle for [Barry Davis’s] [Trade Promotion Authority legislation] on trade deals. He has been working with Boehner’s leadership team convening meetings with Republicans to educate the dozens of junior lawmakers who have never considered a trade deal like the potential Pacific Rim pact [aka Trans Pacific Partnership].

    Just 55 members of the House were in office during the 1993 debate for the North American Free Trade Agreement, and nearly 140 lawmakers — a third of the entire House — have never voted on any trade deal before. The last trade deals, with Panama, Colombia and South Korea, were approved in October 2011.

    There are twelve countries which are participating in negotiations for the Trans-Pacific partnership. Four of these have already ratified the Trans-Pacific Strategic Economic Partnership Agreement in 2006, while eight more have joined negotiations for the Trans-Pacific Partnership, whose text has not yet been finalized.

    Potential future members:

    South Korea is not part of the initial agreement, but it has shown interest in entering the TPP, and was invited to the TPP negotiating rounds by the US after the successful conclusion of its Free trade agreement between the United States of America and the Republic of Korea in December 2010. South Korea already has bilateral trade agreements with some TPP members, but areas such as vehicle manufacturing and agriculture still need to be agreed upon, making further multilateral TPP negotiations somewhat complicated. South Korea may join the TPP as part of a second wave of expansion for the trade agreement.

    Other countries interested in TPP membership include Taiwan, the Philippines, Laos, Colombia, Thailand, and Indonesia. According to law professor Edmund Sim, many of these potential countries would have to change their protectionist trade policies in order to join the TPP. Other potential future members include Cambodia, Bangladesh and India.

    The most notable country in the Pacific Rim not involved in the negotiations is China. According to the Brookings Institute, the most fundamental challenge for the TPP project regarding China is that “it may not constitute a powerful enough enticement to propel China to sign on to these new standards on trade and investment. China so far has reacted by accelerating its own trade initiatives in Asia.” However, China may still be interested in joining the TPP eventually.

Proponents say the agreement would result in multilateral economic growth, while critics say it would increase corporate power and make it more difficult for governments to regulate markets for public benefit. The American government considers the TTIP a companion agreement to the Trans-Pacific Partnership. After a proposed draft was leaked in March 2014, the European Commission launched a public consultation on a limited set of clauses and in January 2015 published parts of an overview.

    An agreement is not expected to be finalized before 2016.
