“So we found stuff… but we don’t know what it means.”

On Thursday, April 30th, the Shaka Movement filed a brief with the US Ninth Circuit Court of Appeals.

(Appeal No. 15-15641, IN THE UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT, Appeal from the United States District Court for the District of Hawaii Case No. 1:14-CV-00511-SOM-BMK)

Essentially, it argued for an end to delays and, instead, some real action toward implementing what the voters of Maui demanded last November:

A temporary stoppage of all Monsanto/Dow GMO experimentation in Maui County, and a true investigation of what those corporations have been doing to endanger human health.

In that brief to the Ninth Circuit Court, there is the following statement about the previous work of Hawaii Dept. of Agriculture inspectors—work done before the November vote.

Buckle up. It’s a shocker:

“…no testing has ever been conducted in Maui County to demonstrate that the GMO practices are not harmful, nor are there any permitting requirements addressing these harms. (2ER 158-159). The federal and state agencies that Monsanto and Dow claim are overseeing these activities admittedly do not protect against any of these harms, nor do they have any rules setting standards for safety. (2ER 021-027). According to the Hawaii Department of Agriculture (“HDOA”), the agency which Monsanto and Dow have pointed to as the agency responsible for regulating the safety of these activities:

“’We looked into stream sediments specifically for glyphosate, for Roundup, and we found Roundup in all of the samples that we took. All in all, we found 20 herbicides, 11 insecticides, 6 fungicides, 7 locations with glyphosate but no EPA benchmarks, there are no EPA benchmarks for sediment, for glyphosate. So we found stuff but, frankly, we don’t know what it means and no one in, we don’t know how to compare that to any kind of health standards. So there’s additional work that needs to be done there. (2ER 268)’”

power outside the matrix

No guiding rules, no guiding standards, and no clue about what these inspectors were finding, other than glyphosate, which the World Health Organization has just declared a probably carcinogen.

You can read the full Shaka brief here.

The bottom line is: what the hell is going on in Maui County? Who’s minding the store? Apparently, no one. And the spraying of experimental pesticides continues in the open-air laboratory of Maui. The federal judge in the case, Susan Oki Mollway, appears to be doing everything in her power to cater to Monsanto and Dow, and discount, step on, and destroy a legal vote calling for a real investigation.

Justice? Never heard of it.

Bio-research centers like Plum Island are now an obsolete concept. Research can now be carried-out wherever the governmental/corporate/academic science cabal desires. Kevin Mugur Galalae clearly sums up the overall global objective in his book ‘Killing Us Softly’.

No testing has ever been conducted in Maui County to demonstrate that the GMO practices are not harmful, nor are there any permitting requirements addressing these harms.

BECAUSE:“’We looked into stream sediments specifically for glyphosate, for Roundup, and “we found Roundup in all of the samples that we took”.

WHO WOULD HAVE FIGURED THAT, THEY WOULD FIND ROUND-UP POLLUTION ON MAUI…??

All in all, we found 20 herbicides, 11 insecticides, 6 fungicides, 7 locations with glyphosate but no EPA benchmarks, …there are no EPA benchmarks for sediment, for glyphosate. (WTF….THEY FOUND POISON BUT, NOW WHAT DO THEY DO WITH THESE RESULTS..)…

So we found stuff but, frankly, we don’t know what it means and no one in, we don’t know how to compare that to any kind of health standards.
(THEY FOUND POISON WITH WITH NO-STANDARDS OF DANGER)

So there’s additional work that needs to be done there. DAAAA

The federal and state agencies that Monsanto and Dow (OWN) claim are overseeing these activities AND “admittedly do not protect against any of these harms”, nor do they have any rules setting standards for safety.

    THIS IS TOTALLY UNREASONABLE…

The bottom line is:”what the hell is going on in Maui County”?
AND, “WHO IS IN CHARGE” THAT REALLY CARES..?

AND, Who’s minding the store? Apparently, no one…??

BUT, WAIT….SHE STILL HAS NOT DONE ANY “RULING” YET”…

AND THIS KIND, CONSIDERATE, AND “VERY HONORABLE” (AND FROM THE HIGHEST COURTS IN OUR LAND)…SUPERIOR COURT JUDGE “SUSAN OKI MOLLWAY”..STILL CAN DO THE RIGHT THING HERE IN HAWAII…AFTER ALL…

I AM REALLY REALLY SURE…SHE DOES “NOT” WANT ….OVER 23,000+….”CONCERNED VOTING AMERICAN CITIZENS OF HAWAII”..WHO “WON THEIR VOTE”…(AND THEN THERE IS THE “WORLD NEWS”…THAT IS ALSO WAITING FOR HER TO RULE..)…

WHO..DEMAND TO KNOW THE “REAL TRUTH”…ABOUT ALL THESE CORPORATIONS….WHO ARE USING “HIGHLY TOXIC”…TOTALLY EXPERIMENTAL CHEMICAL’S..(THAT TO THIS DAY)…”NOBODY IS CHECKING”…FOR THEIR SAFETY….

AND, IF SHE THINKS…THAT IT IS PERFECTLY “OK” TO DEPEND ON A “CORPORATION LIKE A MONSANTO”…TO TELL US THE “REAL TRUTH ABOUT THEIR OWN CHEMICAL’S”…SHE WILL BE MAKING A VERY “DRASTIC MISTAKE”…~!!

BECAUSE, WE WILL “NEVER STOP”…UNTIL THE “REAL TRUTH” HAS THIS LIGHT SHED UPON IT”….

    “SCIENCE AND CONFLICT OF INTEREST”…
    THERE IS A DIFFERENCE…~!

    • And please, never give up, ive watched too many die here, and now im infected, very sick, all the “doctors” will tell me is my immune system is gone, dont give up, for all the dead, and dying.

  3. Yes sir Jon, its true, dam corrupt money, all paid to be silent, ive traced it to the hospitals, all the way to Josh Green, senator, and head of medical, Hawaii. sad as hell sir. GYPHOSPHATES I spelled that wrong, but its the active ingredient in round up, its the cancer causing poison, that the crops have been engineered to resist, but our bodies, have only so much resistance. I fear our ground water aquifers are highly contaminated. So far, NO radiation in the ocean, but it fluctuates in our air now. ALL state agencies quiet, no answers, neophytes on every line.

We want all open air field trials of GM crops stopped immediately in the country since such open air trials pose not only a risk of contamination but also risk of trade rejection. Further, any moves towards trade liberalization in agriculture whether through the WTO route or through free trade agreements are unacceptable to us.”

Hui asks appeals court for hearing on Maui law

A judge’s injunction should not stand, the group contends

    By Timothy Hurley

    POSTED: 01:30 a.m. HST, May 05, 2015

The group that campaigned for a Maui ban on the cultivation of genetically modified organisms has appealed to a higher court in an attempt to free up the legal logjam that has prevented the law from going into effect.

The SHAKA Movement and its leaders — Lorrin Pang, Mark Sheehan, Lei‘ohu Ryder, Bonnie Marsh and Alika Atay — are appealing to the 9th U.S. Circuit Court of Appeals in hopes of compelling the federal District Court in Honolulu to hold an evidentiary hearing that might halt the injunction in the case.

In its appeal filed Thursday, SHAKA argued that the court abused its discretion when it agreed to continue the injunction that was entered into by an agreement between Monsanto Hawaii, a unit of Dow Chemical Co., and Maui County following the ballot initiative that was approved Nov. 4.

U.S. District Judge Susan Oki Mollway in March asked the parties involved to continue the injunction in light of provisions in a couple of agriculture bills in the state Legislature that might have an impact on the issue.

When SHAKA objected, Mollway asked the group to submit a 2,500-word brief that was due within three days, and then ultimately denied the group’s request.

Michael Carroll, an attorney for the group SHAKA Movement, said the judge denied a fair hearing and erred by giving more weight to the potential economic losses of the seed companies than to the hardships imposed on the people of Maui County in the form of exposure to more GMO cultivation and the pesticides used by the industry.

Sheehan, spokesman for the citizen group, said the judge’s continuance sends a message to Maui County voters that “your health concerns are secondary to industry profits, and your voting rights are secondary to the power of corporations to deny implementing your ordinance.”

In its appeal, SHAKA asks for an expedited hearing.

“We just want to get the law implemented because it needs to be enforced immediately,” Sheehan said.

John Purcell, Monsanto of Hawaii’s vice president of business and technology, said in a statement that the company respects SHAKA’s right to appeal the injunction.

“However, we are confident our legal arguments are formidable and will prevail since they are based on established legal precedent,” he said.

The measure, as approved by the voters, imposes a moratorium on the growing of genetically engineered crops until an environmental and public health study can show they are safe.

Monsanto and Dow spent nearly $8 million underwriting an election campaign that set a record for the most money spent on a local initiative in Hawaii.

According to SHAKA’s appeal, these companies use the land in a more destructive way than most farming operations by using high levels and combinations of repeated pesticide application and using a disproportionately small portion of the land, “leaving large areas barren and more susceptible to causing environmental pollution.”

The appeal said that despite the harm these companies cause, “no testing has ever been conducted in Maui County to demonstrate that the GMO practices are not harmful, nor are there any permitting requirements addressing these harms.”

The seed companies deny causing any harm and say they operate legally under the scrutiny of plenty of government regulation. They have argued that the new ordinance conflicts with state and federal laws that support the lawful cultivation of GMO plants.

What’s more, they say the law will hurt the local economy and those who rely on GMO crops to support their families. It will also render valueless multimillion-dollar investments made by the seed companies and end up bankrupting Molokai, whose economy is more dependent on the seed industry, they say.

Pleas note that we have just won the first task in that glyphosate products in CA will now be labelled as cancer causing — it’s a start (and Monsanto is not happy).
